At around 9 PM, Sgt. Watt was driving North on Vernal Ave when a vehicle turned onto Vernal Ave from 600 North. The car failed to stop and turned the corner at a high rate of speed.
As the vehicle rounded the corner, the headlights went side to side, like the car was losing grip and spinning its tires. As the car passed the officer, it was going well over the speed limit. The officer turned around to stop the vehicle. As the vehicle slowed down to turn West on 400 North, it again acted like it was spinning its tires.
The car stopped at approximately 100 West 400 North. Sgt. Watt contacted the driver, who was identified as 36-year-old Krystal Louise Raven.
As they spoke about the reasons for the stop, she acknowledged not stopping and stated something about her front tires being bald. As she spoke, the officer could smell the strong odor of alcohol coming from her breath. The officer asked her about drinking alcohol, and she stated she didn't drink enough to be drunk.
Sgt. Watt had Krystal step out of the car and perform field sobriety tests. She eventually agreed.
Throughout the test, Krystal complained about having scoliosis and not being able to balance. The officer did not observe her lack of balance when he had her step out of the car and stand at the back while he turned off his forward-facing lights.
Based on Sgt. Watt’s observations of Krystal and the performed tests determined there was probable cause to arrest Krystal for driving under the influence. He took her into custody, but she began to resist during the arrest and pulled away, demanding that the officer call her husband and have him come to the traffic stop.
Once arrested, she refused to get into the patrol truck, and officers had to physically lift her into the truck.
On the way to jail, Krystal continued demanding that the officer pull over and call her husband and that the arrest was illegal. She also stated that Sgt. Watt arrested her without giving her a breath test.
At the jail, she was taken to the area where the Breathalyzer was, and the officer began an attempt to read and explain the admonitions on the DUI report form. As he was reading the reason for the arrest and first admonition, Krystal continued to argue about being arrested and not the Sergeant not calling her husband.
Sgt. Watt asked Krystal if she would submit to a breath test. She responded by yelling, "No, sorry, no, I disagree. You have not given me a breath analysis, among other things." Krystal was not cooperative, continued demanding things, and wouldn’t do the breath test.
The officer read Krystal the refusal admonition and asked again if she would take the test. Instead of answering yes or no, she continued to demand that he call her husband. He asked if she was refusing the breath test, and she said no, but she continued to make demands and wanted to argue.
After a minute of trying to reason with her to take the test, the officer ended the conversation.
The jail staff, who was standing by, came over to take her to a cell, and she began to pull away again. Several corrections deputies picked Krystal up and carried her into a holding cell while she yelled, kicked, and screamed. Krystal was secured in a holding cell where she yelled and kicked and hit the door over and over for a long period of time.
Since Krystal refused to take a breath test, Sgt. Watt submitted a search warrant for a blood draw. When the warrant was approved, he went to the holding cell to get Krystal to take her to the hospital. The officer asked for a set of belly chains to secure her for the ride, but she got upset and refused to be put in chains. Krystal was then handcuffed for the transport.
On the way to the hospital, Krystal continued to demand that Sgt. Watt call her husband to meet her at the jail.
In the hospital ER room, Krystal asked the staff to call her husband, but they told her no. The nurse was prepping her arm for the blood draw and was just about to poke the needle when Krystal pulled her arm back, again demanding that her husband be called and present.
The officer grabbed her arm and pulled it back straight; when she started to move her body forward, he held her right shoulder against the hospital bed while the nurse did the blood draw.
Krystal continued to yell the entire time, claiming she was being hurt. Once the blood draw was completed, she was handcuffed and escorted back to the patrol truck and then to jail.
Krystal Louise Raven may post bail in the amount of $2,280.00.
