A “sovereign citizen” gets himself arrested for DUI and several other charges

A man on a motorcycle was traveling 78 mph on US-40 near mile marker 101 in Duchesne County when Cpl. Cox stopped the driver.


When the rider got off his bike, the deputy noticed he was carrying a large knife on his waist and a pistol in his vest, and his motorcycle didn't have a license plate.


The deputy was speaking with the rider about his missing plate, and he stated that he didn’t have to have a license plate because he is a “sovereign citizen.” When asked for his driver’s license, he said he didn’t have to have one of those either.


Cpl. Cox asked for the man’s name, and he said it was 43-year-old Todd Wetzel Flygare.


Todd was told that his weapons would be removed only during the traffic stop and for the deputy's safety. Todd stated that Cpl. Cox also needed to remove his weapons.


Todd was making the decision not to comply, so the deputy decided to detain Todd for the duration of the stop. However, Todd stated that he would not be detained. He was asked to place his behind his back multiple times, and Todd said he wasn't going to do that. Cpl. Cox told Todd that if he didn't, he would be tased.


Eventually, Todd complied and was placed into handcuffs.


It was found that Todd's driver's license is denied; the motorcycle showed no insurance and was expired. Todd claimed that he had a bond for his insurance. The paperwork appeared to have been printed from a home computer and did not appear to be valid.


Todd was then told he was being placed under arrest and asked if he had anything illegal on him before going into the police truck. Todd replied that he had “crystal” in his pant pocket. The deputy found a small plastic pipe with a white crystal substance consistent with meth.


During an inventory of Todd’s motorcycle for impound, another green container was located with a large amount of a white crystal substance consistent with meth, and another black container with a large amount of meth. A funnel was also located with the items, along with a ledger indicating consistency with sales of narcotics.


Cpl. Cox read Todd the driver's license admonitions and requested that he submit to a chemical blood test. Todd refused and was read the refusal admonition. Todd still refused.


A search warrant was approved, and a nurse drew two vials of blood.


Todd received a medical clearance from the hospital and booked into the Duchesne County Jail.
