At 9:20 PM, Naples City Police Officer Silcox and Training Officer Roth heard an Attempt to Locate (ATL) a reckless driver broadcast over the radio for a black Chevy Tahoe, stating it was unable to maintain its lane and its speed was inconsistent.
The officers waited at the 2500 S 1500 E intersection for the Tahoe, and when it passed by, they pulled onto the highway and began to follow the vehicle. The Chevy changed speeds twice, by hitting its brakes and accelerating, and failed to maintain its lane of travel several times.
The license plate number matched the one the complainant had provided to dispatch, and the officer initiated a traffic stop.
The Chevy Tahoe pulled into a parking lot and came to a stop. Officer Silcox approached the vehicle and immediately could smell the odor of alcohol. The driver was later identified as 24-year-old Rilee Rey Searle.
While at the window, Officer Wilcox could see an open container of Arnold Palmer spiked lemonade in the cup holder. Later determined to have been half full, along with a case of alcoholic drinks in the passenger seat.
Rilee was asked how much she had to drink tonight, and she said nothing. The officer then asked what the open container was in the cup holder, and she stated, "Oh! That was from earlier."
At this time, Rilee was asked to exit her vehicle and informed that they would perform some tests to ensure she was safe to drive.
After the field sobriety test, Officer Roth then told Rilee that, based on her signs of impairment, she was going to be placed under arrest for driving under the influence of alcohol.
Rilee was asked to perform a portable breath test, to which she refused. Rilee was then placed under arrest. Officer Roth checked Rilee's driver's status, which returned as valid, but with an alcohol restriction.
During the vehicle search before being impounded, Officer Silcox found multiple open and unopened cold alcoholic drinks.
Rilee was then transported to the Uintah County Jail and read the DUI admonitions. Afterward, she was requested to submit a breath sample, but she initially refused. After reading and explaining the refusal admonition, Rilee decided to submit to a breath test.
Rilee provided a breath sample that returned as a .168 BrAC.
