Man found passed out in his truck playing loud music

Cpl. Ross was in the area of 165 East 760 South in the Silver Pines apartment complex when he was informed about a gray truck playing loud music in the parking lot.


As the officer walked toward the vehicle he noticed one occupant in the driver’s seat with the keys in the ignition and the vehicle was turned on. After multiple attempts of hitting the driver and passenger side windows, the driver eventually woke up.


Officer Murray and Cpl. Ross started to speak with the driver, who was identified as 22-year-old Randall James Cuch, as he began revving the motor before placing the truck in neutral.


Randall was ordered out of the vehicle, where the officers could smell a heavy odor of alcohol emitting from his person.


When asked how much he had to drink, Randall stated, "Not a lot."


Cpl. Ross asked Randall for his driver's license, which he presented to the officer with a vape pen.


Randall's mood fluctuated during their interaction, ranging from upset and angry to visibly sad and crying. He would place his arms in front of himself, simulating being handcuffed while stating, "Just arrest me, bro. " " Take me down to the station." "I don't remember driving."


Cpl. Ross requested Randall submit to SFSTs (standard field sobriety tests), which he accepted. During the HGN test, Randall began to cry and would not open his eyes. He tried multiple times to get Randall to cooperate, but he would either keep his eyes closed or, when he did have them open, not follow instructions.


After multiple failed attempts and Randall submitting to custody multiple times, he was placed in handcuffs.


Randall was transported to the Ashley Regional Medical Center Emergency Room. While at the hospital, he stated to hospital staff that he had his last drink at a bar at approximately 2:00 a.m.


Randall submitted to a PBT at the hospital, and the results were .147 BrAC.


The officer advised Randall of his rights per Miranda, and when asked where he was going, Randall said, "I wasn't really goin no where.”


When asked if he had been drinking, Randall stated, "Nope," followed by being asked where he had his first drink. Randall stated, "Swains."


Randall stated he did not think he was under the influence of alcohol or drugs currently. He also said he had been listening to music for the last three hours. Randall stated he was at the bar earlier and did not recall if he drove.


 Based on the affirmation of Cpl. Ross, the arresting officer, the undersigned magistrate finds that probable cause existed for the arrest without a warrant of Randall James Cuch.


Randall James Cuch may post bail in the amount of $1,460.00.
