Man Caught Placing Items Down His Pants At The Family Dollar

It was reported that a white male wearing a black tank top and tan pants was placing items down his pants at the Family Dollar, located at 620 West Main Street, Vernal, Utah.
Vernal City Police Officer Oldham arrived on scene first, and identified the male as 37-year-old Colton Daniel Lowe. A records check revealed that Colton had two active arrest warrants.
Cpl. Randall arrived on the scene, and Officer Oldham gave him a receipt. Officer Oldham stated that the receipt was Colton's for all the items Colton had placed in the trunk of his vehicle.
The Corporal entered Family Dollar and spoke with the store's assistant manager. The manager stated that a customer had informed her Colton was putting merchandise down his pants.
The manager said she looked over and observed Colton with his hands in his pockets, but she didn't physically see him place anything in his pockets.
Officer Oldham arrested Colton for the warrants, left the store, and took Colton into custody.
Officer Oldham found two packs of batteries and a toothbrush on Colton's person. The items were taken back inside the store to check if they came from the Family Dollar, and it was confirmed that they did.
The police impounded the vehicle to hold for its owner. It was found that Colton was not the registered owner. As part of the impound process, the vehicle was inventoried.
During the inventory, Cpl. Randall found a small black bag on the front passenger floorboard. It was opened, and the small black bag had Colton's Utah driver's license. Also located in the vehicle was a small Ziploc bag containing a brown powdery substance known to be Heroin. Additionally, Cpl Randall located a white bag containing a white crystalline substance consistent with methamphetamine. He located a gray plastic straw. The straw had been melted and bent. It's the kind of straw that is used in the consumption of illegal narcotics.
Officer Oldham transported Colton to the Uintah County Jail. When Cpl. Randall arrived, and Officer Oldham informed him that Colton had placed Little Tree brand air fresheners in his patrol vehicle. Officer Oldham stated that Colton denied placing the air fresheners in his vehicle.
While at the jail, Colton was advised of his Miranda rights and asked if he knew what had been found in the vehicle. Colton stated he did not. He was asked if he knew about the black bag that contained his Utah driver's license, and Colton said he did not. Cpl. Randall asked if the illegal narcotics in the bag were his, and Colton stated it was not. He was then asked if he had placed the air fresheners in Officer Oldham's truck, and Colton said he did not want to get in trouble for taking them into jail.
Colton stated he purchased the air fresheners at a Family Dollar in Orem and was going to return the air fresheners, batteries, and toothbrush to Family Dollar. Colton stated he bought all of the items from a Family Dollar in Orem, but he didn't have a receipt for the items.
Cpl. Randall returned to Family Dollar and confirmed that two of the air fresheners were taken from the Vernal store. This was done by scanning the bar code and performing an inventory count. The inventory count was missing one item for two different air fresheners, both packs of batteries and the toothbrush.
A records check was performed on Colton, who has two previous convictions for possession of a controlled substance and two previous convictions for theft in the last ten years.
Because of these convictions, the charges of Possession of a Schedule I or II Controlled Substance and Retail Theft/Shoplifting will be enhanced one degree.
Colton Lowe was booked into the Uintah County Jail on the following charges:
Two counts of Possession of a Schedule I or II Controlled Substance.
One count of Use or Possession of Drug Paraphernalia.
One count of Retail Theft/Shoplifting.
One count of Tampering With Evidence.
