Male & female stopped for broken headlight, arrested for drugs

| Duchesne, Ut. | November 25th, 2024 |


A white passenger car was seen driving through Duchesne with a broken passenger side headlight and had its high beams on.


Cpl. Cox located the vehicle as it was leaving Duchesne City, heading West on US-40. The officer watched the driver drift to the right and left within its lane.


The officer passed the vehicle, and the driver failed to dim the headlights, and one of the headlights was, in fact, not working. Cpl. Cox got back behind the vehicle and initiated a traffic stop at milepost 85.


There were two occupants inside the car. The officer recognized the driver as 31-year-old Cody Austin Mayhew, who is a known drug abuser. The passenger in the vehicle was a female who appeared nervous and possibly under the influence of drugs.


When the female passenger was asked for her ID, she told the officer she didn't have it and identified herself as Ember Mitchell, born on 2/21/1989.


Cpl. Cox also found that Cody is currently on probation with AP&P and that his driver's license has been denied.


The officer attempted to find information on the passenger using the name she provided but couldn't find anyone with that name and date of birth.


He then had Cody exit the vehicle to speak with him. Cody's pupils were pinpoint, which is an indication of narcotic use. The officer asked Cody if the passenger was providing the correct information, and he stated that she was.


Cody was asked if there was anything illegal in the car, and he said no. Cody was advised that his probation officer would be contacted and asked if he wanted a compliance check done.


Cpl. Cox continued to attempt to identify the passenger, who he believed was lying about her name.


Cody became very nervous and claimed that Cpl. Cox was harassing him.


The officer called AP&P Agent Coil, who said he would be on his way to assist at the traffic stop.


While waiting for Agent Coil, Cpl. Cox spoke with Ember again and asked for her social security number. When he ran her social security number, it returned to a male with the last name Mitchell.


The officer located a file with a female with the same first and last name as Clapper. He confirmed that Clapper was, in fact, her real name and ran her name for a warrant check, which showed a statewide warrant for 35-year-old Ember Nicole Clapper's arrest.


Ember was placed under arrest, and melted tooter pipes were located in her jacket pocket with residue inside of them. Ember stated that the tooter pipe located on her person with be for "Oxy's," or oxycodone.


Agent Coil arrived shortly after and began to speak with Cody. Cody told Agent Coil that he had a hypodermic syringe needle in his blue backpack.


Cpl. Cox continued to search Ember's property and located two more melted tooter pipes with residue. One of the pipes tested positive for amphetamines; the other tested positive for fentanyl.


The Cpl. Began to search Cody’s backpack and found two hypodermic syringe needles and a tube with residue commonly used for methamphetamine.


While Cody was speaking with Agent Coil, he also admitted to having items on his person and recovered a blue pill commonly known as fentanyl and two melted tooter pipes.


Cody was read his Miranda Rights and admitted to using both meth and fentanyl.


Cody was then booked into jail for driving under the influence of drugs-1st offenses in 10 years, possession of a controlled substance for the meth and fentanyl located, possession of drug paraphernalia for the items used to facilitate the use of illegal substances, and failure to dim headlights. Cody also has 3 prior drug convictions within the last 7 years, which makes his current offenses felonies.


Ember was transported and booked into the Duchesne County Jail for her statewide warrant, false info with intent to be an actual person, possession of controlled substance fentanyl and meth, and possession of drug paraphernalia.
