During A Traffic Stop, A Duchesne County Deputy Finds 52 Grams Of Meth

While on patrol, Deputy Cox observed a white vehicle traveling eastbound on SR-35, then turning South onto SR-87 toward Duchesne. While the vehicle was at the stop sign, the deputy ran the license plate, which came back expired on 4/30/24.
Deputy Cox turned around, caught up to the vehicle, and initiated a traffic stop at 5000 South SR 87.
The deputy approached the vehicle, recognized the driver (Unknown), and knew that she was on probation. He also saw another female occupant in the passenger seat.
The driver stated that she didn't have a license. Deputy Cox asked for her consent to search, which she gave. The female passenger started to reach around, grabbing things. The deputy told her not to pick anything up and asked her to exit the vehicle.
The female passenger was identified as 52-year-old Heather Davis.
Heather stated she didn't want her things searched "Because everything is a mess." She was advised that it was her right to deny consent. She was also advised that the deputies currently have a K9 officer working and could have him come to the traffic stop.
Heather began acting nervous and immediately grabbed her things when the driver consented to search her car.
Deputy Cox asked Heather if she had anything inside the vehicle that he should be aware of. Heather said she didn't think so and pointed out that the purse at her feet and a green camo bag were what she had with her in the vehicle. Heather then gave the deputy consent to search her belongings.
The deputy started his search on the driver's side of the car and worked his way to the back seat. In the back seat was a tall bag with towels on top. Under the towels was a feminine bag that was locked. Heather did not point out this bag at the time.
Deputy Cox opened the bag by moving the combination by one digit. Inside the bag were several small empty baggies commonly used for containing drugs, hypodermic syringe needles, and a vacuumed sealed bag. In the bag was 52 grams of meth and a scale with residue on it. These items are commonly used in drug sales. Heather said the tall bag belonged to her.
Deputy Cox showed the bag that had the meth inside to Heather, and she said she didn't recognize it.
Heather Davis was placed in handcuffs and then read her Miranda rights, which she said she understood.
Deputy Cox confirmed with Heather that she had yet to point out this bag as her property before the search began.
Heather stated that her ex packed all of her stuff because they are separated, and she picked it up from an acquaintance yesterday. She said that she wasn't sure if her ex was using or selling drugs but stated that they were not hers. She also said that it doesn't belong to the driver.
After Heather was placed in handcuffs, she told the deputy that she had a pipe in her bra. Heather reached into her bra and pulled out a glass pipe with a white crystal substance consistent with meth and a small bag with a gram of meth. She said that she may have another in her pocket. Another gram of meth was found in her left front pocket.
Heather was transported to the Duchesne County Jail and booked in for possession with intent to distribute methamphetamine and drug paraphernalia.
Based on the affirmation of Deputy Cox, the arresting officer, the undersigned magistrate finds that probable cause existed for the arrest without a warrant of Heather Davis.
Heather Davis may post bail in the amount of $5,000.00.
If Heather Davis posts bail as stated above, Heather Davis is hereby ordered to be released subject to the following conditions:
• Promise to appear for all required court proceedings
• Promise to not commit any criminal offense
• 4th Amendment Rights Waiver in agreement
• Fee: $250 (per month)
• GPS ankle monitor
• Random drug testing (up to 3 times per week)
• Warrant amount for failing to call in: $100 (per month)
In those jurisdictions where pretrial release and supervision authority has been granted by written agreement, defendants may be released to pretrial services without posting bail, consistent with the terms of that agreement.
