An abandoned vehicle found on a hillside close to rolling over in Naples

According to the affidavit, at 5:23 on Saturday morning, Officer Roth was dispatched to an abandoned vehicle found off the side of the road in Naples with the driver-side door left wide open.
When the officer arrived at the scene, he noticed that the vehicle was in a very risky spot, around a curve, and on a very steep angle on a hillside.
No occupants were found inside or outside of the vehicle. However, it was registered out of Roosevelt to 21-year-old Kylee Taylor Berry.
Officer Roth contacted RPD to have them attempt to locate Kylee to figure out what was happening with her vehicle.
As the officer began to take photographs of the vehicle, he didn't get too close as the vehicle appeared very unstable. While taking photographs, he noticed that there was an open container of alcohol in the driver's side door panel, along with a box of THC and beer bottle caps.
Due to finding this and the sheer hazard that the vehicle could roll at any minute, Officer Roth called for a tow truck to remove the vehicle from its location.
RPD contacted Officer Roth to give him an update, and they were able to find contact information for Kylee's boyfriend, who lives in Naples. They were told Kylee was with him and safe. She had called him for a ride after crashing her truck on the side of the road. RPD advised that Kylee was expecting a call from Officer Roth and would be heading back to the scene of the wreck soon.
Officer Roth wasn't able to contact Kylee by phone, but her boyfriend's mother showed up at the crash scene a short time later.
The mother stated that her son and Kylee had been fighting throughout the night, and at one point, the boyfriend left the home to cool off while Kylee stayed home upset, slamming doors. She stated that the fighting continued when her son returned home and Kylee left in her truck. Her boyfriend then left to pick her up because she wreaked her truck. After she was picked up, her boyfriend requested that his mother stay with Kylee.
Officer Roth asked the mother about the alcohol containers he saw in the truck, and she stated that she didn't believe that Kylee had been drinking and didn't see her drink anything.
In speaking with the boyfriend about these same details, he stated he left Kylee at the residence for some time to cool off, and when he returned, the fighting started again. Kylee left for about 45 minutes before calling her him about the crash.
The boyfriend said he never witnessed Kylee consume any alcohol, nor did he see her with any alcohol. He also stated he didn't believe she had drunk anything after the crash because she had been with his mother during that time and wouldn't believe she drank anything in front of his mom.
A short time later, Kylee and her boyfriend arrived at the scene, and Officer Roth spoke with both parties individually.
In speaking with Kylee, she stated that her friends probably left the open containers in the truck in the back seat. Officer Roth stated he could smell a "peachy" odor coming from her mouth and person. Her eyes were extremely glossy, her speech patterns were very sporadic, and her behavior was erratic.
Officer Roth asked Kylee about where she was driving and how she had ended up going off the roadway. Kylee stated that she was going home. This statement did not make sense to the officer as both her boyfriend's house and her house in Roosevelt were in the opposite direction of where her vehicle was facing when it had left the roadway. Kylee's story about this incident changed and never remained consistent.
At this time, Kylee volunteered to do a breath test, saying she hadn't been drinking anything. This reading came back as .147 BrAC.
When the officer returned the PBT to his patrol truck, Kylee asked, "Sir, can I talk to you in private?" "I don't want his mom to hear this."
Kylee stated she had seen the numbers on the breath test and stated again that she had not been drinking. Kylee continued to change her story multiple times throughout this process, from saying she had consumed no alcohol to saying she had then consumed only one tall boy but that it was after the crash. Again, this information contradicts what her boyfriend and his mother had stated.
A search of the truck was conducted because the open containers were visible. During the search, Officer Roth found open containers of Coors Light, Bud Light, Monster (alcohol), and a nearly empty Peach Flavored Crown Royal bottle in the center console. He also found an empty THC container that would have been purchased from a dispensary holding a 1g rolled "blunt" of the substance. No THC was located during the search.
Officer Roth smelled the Peach Crown Royal before pouring the rest out and noticed that it was identical to the odor he smelled coming from Kylee’s breath.
After transporting Kylee to the Uintah County Jail, Kylee submitted a breath sample reading 0.127.
During the DUI interview with Kylee, her statements continued to contradict themselves. Officer Roth asked Kylee if she had been in a car accident, to which she answered she had not and only went off the road. The officer agreed and said that she did drive off the road, all the way off the road, as none of her tires touching the roadway.
Kylee started yelling and said that he was making her sound like an alcoholic. Kylee eventually declined to answer any other questions, stating that she felt unsafe speaking with Officer Roth.
