Sgt. Johnstun responded to a disorderly call at 1385 West Main Street. While en route, dispatch advised the officer the complainant said Joey was intoxicated and trying to fight, and Joey had a gun earlier, but he doesn't have it now.
The officer arrived at the residence and saw a male, later identified as 47-year-old Joseph Lorin Sheffer, stumbling in the driveway. Joseph had blood on his face and a strong odor of alcohol emitting from his breath. It appeared Joseph was very intoxicated.
Sgt. Johnstun contacted Joseph's wife and her 25-year-old son. His wife stated Joseph and her son had been fishing and drinking earlier. She stated Joseph arrived home and was drunk, sitting on the front porch with a pistol in his lap. His wife was concerned he was suicidal and asked him to give her the gun, and he handed it over to her.
His wife said she and Joseph were arguing loudly, and he was calling her vulgar names. Tiffany indicated her children, who were inside the residence, called her older son and told him about the fight and the gun.
His wife stated that her son had come over to the house and that he and Joseph had begun to argue. She stated Joseph was yelling at her oldest son and shoved him. She said her son then punched Joseph, and he fell to the ground. His wife indicated she had four minor children inside the residence who heard the altercation.
Sgt. Johnstun spoke with the son, who relayed the same version of events as his mother. The officer also spoke with two witnesses who also stated the same story.
The son stated Joseph is his stepfather, and they had previously lived in the same home.
The officer then spoke with Joseph, who stated he and his wife were arguing, and someone called her son. He said her son came over and started punching him. Joseph denied pushing the son.
It was determined there was probable cause a physical altercation had occurred. I determined Joseph was the predominant aggressor in the altercation, and there was probable cause Joseph had committed a domestic violence offense in the presence of four children.
Based on these determinations, Joseph was arrested and transported to the Uintah County Jail. Joseph was booked into the Jail for assault, intoxication, and four counts of domestic violence in the presence of a child.
Joseph Lorin Sheffer may post bail in the amount of $2,000.00.
