A Roosevelt man pepper-sprays the neighbor's dogs, then leaves the scene on a golf cart while getting a ticket

Roosevelt Police Officers responded to a residence on a report of animal cruelty. The caller stated that 80-year-old David Charles Boender had pepper-sprayed their dogs while they were in their yard.


It was also reported that the daughter of the complainant went to pick up one of the dogs and started reacting to the effects of the pepper spray, also stating that the dogs were in pain and crying.


While speaking with the complainant in their backyard, David pulled up along the fence in his golf cart. The police tried to get his attention, but he drove off.


Officer Bellon went to the front of David's property and made contact with him. David denied using pepper spray on the dogs, but did admit to owning some pepper spray. When asked what he used the pepper spray for, David avoided the question.


The officers told David several times to hang on while they got some paperwork for him. Before they could finish the citation, David began driving away down his driveway toward his house.


The police yelled, trying to get David's attention, but to no avail. One officer followed behind David and got on the PA system, telling him to stop. The other officers followed after him and detained David.


David’s wife came out of the house and told the officers that he had been pushing and grabbing her earlier in the day.


Officer Bellon went to move David to a patrol vehicle and could smell the odor of alcohol. He asked David what he had in his pocket, and he said he had a Smith and Wesson Pistol.


In David’s right pocket was a loaded Smith & Wesson Bodyguard .380 that had one in the chamber and six in the magazine. The weapon was removed and secured.


David was placed under arrest on charges of assault with the domestic violence enhancement, failure to stop at the command of law enforcement, cruelty to animals, carrying a dangerous weapon while under the influence, and public intoxication.
