At around 11:15 pm, Deputy Cox was dispatched to the Altonah Cemetery on a 9-1-1 unknown call. The reporting party said he was "crippled" and wanted an ambulance.

The male refused to answer any of the dispatcher's questions, and dispatch believed he was intoxicated.

Upon arrival at the cemetery, Deputy Cox saw a gold-colored Ford Ranger pickup parked in the gravel toward the southeast corner. As he walked up to the truck, he could hear the engine running and a male awake in the driver's seat.

He was the only occupant inside the vehicle and was identified as 35-year-old Chase Robert Krissman. When Deputy Cox walked up to the driver's side window, Chase's pants were down to the floorboard, one hand was on his genitals, and his other hand was holding his phone, watching pornography.

While speaking with Chase, the deputy could smell a strong odor of alcohol coming from his person. Deputy Cox asked Chase why he called 9-1-1, and he stated that he was disabled and couldn't walk right now.

The deputy also saw that Chase had an open container of beer in the cup holder and a case of beer in the passenger seat.

The ambulance arrived shortly after, and Chase said that he wanted to pee and was able to move himself to the side of the door, leaning against the seat. Deputy Cox asked Chase if he could do a check of his eyes. He was uncooperative and argumentative, but then he said he would allow the deputy to do it.

SFST's:

"I conducted the horizontal gaze nystagmus. I confirmed that both of his pupils were of equal size, and he did not have a resting nystagmus. Chase was not following instructions and would continue not to follow the stimulus. He then said he would cooperate. I conducted the task and observed 6 of 6 clues. I then rechecked his eyes and confirmed that his eyes were tracking together equally. Due to Chase's disability, I did not have him perform the other tests."

"Based on my observations, I determined that Chase is impaired while he is in actual physical control of a motor vehicle. Chase is the sole occupant of his vehicle, which was running upon arrival, and it is clear that he drove the vehicle to the cemetery. Chase also has a revoked driver's license. After conducting an inventory of his vehicle for impound, I located 10 other consumed alcoholic beverage containers. The case of beer only had 1 full container left."~Deputy Cox

Deputy Cox conducted a driver's check on Chase, which returned as revoked. He is also required to have an ignition interlock device installed in any vehicle he drives, but one was not installed in his pickup.

Chase is also alcohol restricted. While Deputy Cox was speaking with Chase at his truck, he had an open container and attempted to consume more alcohol while speaking with him. The deputy had to pull the beer can from his hand.

Chase was transported to the hospital by ambulance. When arriving at the hospital, Deputy Cox read the driver's license admonitions to him and requested a blood draw. Chase consented to a blood draw and a nurse drew two vials of blood from his body.

The deputy then conducted the DUI citation interview after reading Chase his Miranda Right's. Chase agreed to answer questions. Chase would only admit to drinking "Liquid's.” When Chase was asked where he started driving from before the cemetery, he stated that he started on pavement and ended on a dirt road.

Chase received a medical clearance while at the hospital, and then transported to the Duchesne County Jail. Chase was booked in for driving under the influence, an open container in a vehicle, and driving on a revoked license.

Chase Robert Krissman may post bail in the amount of $4,000.00.
