A Female Lies To The Police About Being Choked By Her Husband

Vernal, Ut.-On 5/14/23, at around 1:00 pm, Officer McCurdy was dispatched to 295 North 120 West on a report of a domestic violence incident. Call notes indicated the complainant captured the incident on his cell phone.

When the Officer arrived and met with the complainant, he mentioned that 27-year-old Marigona Ymeri Fancy pushed her husband's head against the wall. The man mentioned he was watching TV with their daughter when the incident occurred. He denied anything physical occurred between him and Marigona besides getting his head slammed against the wall.

The husband described sitting on the couch with his daughter when Margona approached him and pushed his head against the wall next to the window seal, and then Marigona forced him outside. He said Marigona was upset at him and their daughter for watching TV while she was in the kitchen.

The husband showed Officer McCurdy video footage he had captured with his phone, and both Marigona and the husband can be heard yelling accusations at each other. Marigona accused her husband of choking her. In the video, the Officer saw Marigona slap the phone out of her husband's hand, and their daughter said, "Please stop, Mom." Marigona is then seen pushing her husband up the stairs outside the residence.

The husband was confronted about hearing Marigona saying she was choked in the video, and he responded by saying when he started to record, Marigona told him she was going to say she was choked.

The husband reported that Marigona took their daughter to her parent's house.

Officer McCurdy went to Marigona's parent's house, where Deputy Beatty contacted Marigona. She stated her husband was upset over batteries and being aggressive, which led to an argument.

The Officer confronted her about pushing her husband’s head and pushing him in the video. Marigona denied ever pushing her husband’s head into the wall, and he was the one that was upset over batteries.

Marigona stated he choked her with one hand. When asked what hand he choked her with, she said she didn't remember. Marigona then said, "Probably right; he is right-handed.."

Officer McCurdy observed her neck and saw no visible marks indicating someone choked or placed their hands on her neck. When asked about not seeing any marks on her neck, Marigona said, "I didn't think there was anything."

Marigona Fancy was arrested and transported to the Uintah County Jail for one count of assault domestic violence and one count of domestic violence in the presence of a child.
