Uintah County man in Prison for sexual exploitation of a minor & trafficking

Dustin Lane Person, 34, is facing five counts of human trafficking of a child, a first-degree felony; and five counts of sexual exploitation of a minor, a second-degree felony.


Person is being held without bail.

A probable cause statement filed by an officer of the Uintah County Sheriff’s Office says the charges are relate to an incident reported in January.


“Adult Probation and Parole was informed of a possible sexual exploitation of a minor due to a report made that a 9-year-old female … had possibly been given money in exchange for nude photographs. The alleged perpetrator was Dustin Person, a 34-year-old male, who had been on parole for two months due to a previous conviction involving sexual abuse of a 14 year old.


“AP&P did a home visit where Dustin’s phone was taken due to the allegations.”

The child in the current case said Person “gave her his android phone and asked that she take photos of her private parts in exchange for $5,” the statement says.


The child told officials she was afraid Person would get angry, so complied, the statement says. Investigators served a search warrant on Person’s phone, and found five photos taken on Jan. 19, which had been deleted or placed in a trash bin the next day, the statement says.

“Dustin claimed at first he did not know the photos were on the phone, but eventually agreed he had asked (the girl) to take the photos and provided her with $5,” the probable cause statement says.


Person was convicted in 2013 on multiple counts of unlawful sexual activity with a minor and of lewdness.

SEXUAL EXPLOITATION OF A MINOR (3313) in violation of Utah Code Ann. §76-5b-201, a Second Degree Felony, as follows: That on or about January 19, 2020, in Uintah County, the defendant did (a) knowingly produce, possess, possess with intent to distribute, distribute, or view child pornography; or (b) as a minor's parent or legal guardian, knowingly consent to or permit the minor to be sexually exploited as described in Utah Code Ann. § 76-5b-201(1)(a).

PROBABLE CAUSE STATEMENT: The undersigned prosecutor is a Deputy County Attorney with the Uintah County Attorney’s Office and has received information from law enforcement agency(ies) and the case officer, ___ ___, from Uintah County Sheriff's Office. The information herein is based upon such personal observations and investigation of said officers and agencies:


On or about January 19, 2020, in Uintah County State of Utah, the Defendant did solicit nine-year old to participate in the production of child pornography. On the date in question, the Defendant asked_._., of whom he was related, to take photographs of her private parts with his phone. _._. originally denied the request but then took the photographs because she was afraid the Defendant would get mad at her and slap or spank her if she disobeyed. The Defendant unlocked his phone, and_._. took photos of her ''girl part'' with the Defendant’s phone. The Defendant gave_._. $5.00 after she had taken the photographs.


Later, the Defendant’s phone was confiscated by police. Detectives conducted a phone extraction of the Defendant’s phone and located five photographs containing child pornography taken on January 19, 2020. One photograph was of _._.’s breasts and four were of _._.s vagina.


Post Miranda, the Defendant admitted to having _._. take photographs of her private parts on his phone and paying her $5.00 in exchange. The Defendant also stated his phone is password protected, and the Defendant is the only individual with the passcode.


REQUEST FOR ISSUANCE OF A WARRANT:

The State hereby requests a warrant to protect public safety and the welfare of the community. The current offense was committed while the Defendant was on parole.
