Landlord Checks On Noises Coming From One Of The Homes On The Property, Then Gets Attacked By The Tenant

A Uintah County Deputy responded to an assault call near 800 East 4500 South. At the residence, the deputy was met by the adult male victim. The victim stated he heard noises coming from one of the homes on his property.


The victim said he went to the home, knocked on the door, called Justin's name, and then entered without getting an answer. The homeowner was later identified as 28-year-old Justin Ray Cossel.


The victim described the home as messy, with damaged items scattered throughout the residence. When he found Justin, the victim asked what was going on, and Justin began calling the victim names and then was physically attacked.


Justin pushed the victim to the floor, hitting him. Deputy Anderton saw marks on the victim's arms from defending himself. He also had dried blood on his forearms, cuts on his right and left hands, and a cut on his elbow.


Justin was found later that night at Uintah Basin Hospital in Vernal seated in a vehicle in the hospital parking lot when the hospital staff became worried for his welfare and called 911.


Deputy Anderton made contact with Justin at the hospital and asked why he was in the parking lot, and what had happened earlier that night. Justin stated that he had gotten into a fistfight with his landlord, the male victim.


Due to this comment, Justin was arrested and transported to Uintah County Jail.


At the jail, Justin was read his Miranda Warning and agreed to talk with the deputy about the incident. Justin stated that he and his landlord got into a fight, but he didn't want to press charges. Deputy Anderton asked Justin if he could explain what had happened, and he stated that he had better not talk about it anymore, or he would be in trouble.


Justin was arrested and booked into jail for Assault, a class B misdemeanor.


Based on the affirmation of Deputy Anderton, the arresting officer, the undersigned magistrate finds that probable cause existed for the arrest without a warrant of Justin Ray Cossel. Justin Ray Cossel may post bail in the amount of $1,080.00
