Naples City Police responded to the Microtel Inn in Naples on a report that a male had entered the maintenance room and stolen some power tools. They had the incident on their security cameras.
When Officer McGaha arrived, he was provided with Ring video footage that showed a male inside the maintenance room. The male was approximately 5'08 tall, with dark hair and a slim build. He was wearing dark pants and a purple-colored pullover long-sleeve shirt with a blue square emblem on the left chest side.
In the video, the male picks up a Dewalt tool from the workbench and walks around the room, appearing to examine various items. He then grabs a towel from a nearby housekeeping cart and wraps the tool inside. After he searches the room, he takes a Dewalt radio from a mobile tool cart. He then slouches down and appears to sneak out of the room.
The officer conducted a price check and found information from the motel about the value of the items. The combined value of the stolen items was $478.00. The Dewalt Radio was valued at $179.00, and the Dewalt Nail Gun was valued at $299.00.
Officer McGaha stayed in the area and re-entered the hotel. While he was at the front desk, a female walked up and requested an extended check-out time. When she noticed the officer, her body posture changed, and her speech shifted from confident to fumbled and stuttering.
The female advised the front desk that she was requesting an extension for two rooms, and the desk staff confirmed that only one person was listed for the rooms. The female was also carrying two breakfast plates and two drinks.
The officer followed her to the fourth floor, where the rooms she referenced were located. The maintenance room is also on this floor.
Officer McGaha knocked on the door of one of the rooms the female claimed to be staying in and could hear both a male and female voice inside. The door to the other room was propped open, and when the officer knocked on that door, he received no response. He returned to the occupied room and knocked again, announcing himself as Naples Police.
A male answered the door, wearing the same shirt as the individual in the surveillance footage.
The officer asked the male for his ID, and the male went back into the room. The officer requested to follow him, and the male allowed the officer to enter the room.
Officer McGaha asked the male where he was and what he was doing around 4 AM. He stated he was doing laundry. The male was asked if he had entered any other rooms, and he said no.
The male gave the officer his Department of Corrections ID card, identifying him as 38-year-old Mitchell Brett Bernard.
The officer informed Mitchell that he had a video of him entering the maintenance room and then advised him of his Miranda Rights. Mitchell stated he understood his rights and wished to continue speaking with me.
Officer MaGaha asked Mitchell again if he had entered the maintenance room and had taken any items that didn’t belong to him. He stated that he did.
The officer then asked where the tolls were and if he could retrieve them. Mitchell retrieved a Dewalt staple gun from a backpack and a Dewalt radio from plastic bags on the other side of the bed.
Mitchell was arrested and placed into handcuffs. The female was asked to take the recovered items to the front desk for the officer.
Once the items were returned to the desk, Mitchell was escorted to a patrol truck. Officer McGaha asked Mitchell why he had taken the items, and he stated, "I was being stupid."
Officer McGaha asked Mitchell why he had stolen those tools since he had a job. He responded, "I've always wanted a Dewalt radio."
The officer asked Mitchell if he was currently on parole or probation due to the DOC ID card, and he stated he was not. He also asked Mitchell how he gained access to the maintenance room. He said that the door was not fully latched and believed it led to the stairwell.
It was discovered that Mitchell Bernard lives and works in Colorado and was only visiting for a shopping trip.
