A Female With A History Of Violence, Arrested For Assault

At around 1:00 am, Deputy Oldham was dispatched to a domestic violence call located near 2000 West 700 South. Dispatch advised that the house was destroyed and the male had left on foot.


When Deputy Oldham arrived, he saw one female sitting on the front porch with two VPD officers. The deputy approached the porch and observed that the door was open, a flower pot was in pieces, and potting soil was all over the living room.


Deputy Oldham began to speak with the female, who was identified as 43-year-old Jennifer Louise Borba, who became very emotional. While speaking with her, the deputy noticed a small laceration on her forehead.


Jennifer was asked if there were any other marks, and she proceeded to show the deputy her arms, where she had multiple scratch marks. Before asking any more questions, the deputy had EMS look at her while he took pictures of the scene.


As Deputy Oldham took photos, he noticed multiple objects in the front yard. He continued taking photos up to the front door and inside. Just inside the front door, what appeared to be a rack containing hats and other clothing items lay on the floor. There was also a hard gun case on top of the clothing rack.


As he continued taking photos in the house, he observed more potting soil in the kitchen area and what appeared to be pieces of wood. The mess continued into the kitchen. Deputy Oldham moved back toward the front door and began taking photos behind the couch in the hallway.


Once the deputy came to the bathroom, Officer Nielson advised him that Jennifer stated that the fight started inside the bathroom. Deputy Oldham took photos of what appeared to be the shower curtain hangers, which were inside the tub and on the floor outside of the tub.


After taking photos, Deputy Oldham returned outside and went to the ambulance where Jennifer was being looked at. He was told by EMS staff that Jennifer was going to be transported to the hospital due to some comments of suicide she made to EMS.


The deputy entered the ambulance and began asking Jennifer what had happened. Jennifer stated that the argument started because she brought something up with the male. When asked what was brought up, Jennifer became very emotional again.


Jennifer was asked what happened inside the bathroom, and Jennifer stated that her husband pushed her into the tub. She admitted to scratching, kicking, and hitting her husband. Jennifer also admitted to throwing all the objects inside the house.


Sgt. Watt with VPD was able to locate the husband and Sgt. Hill, with UCSO, transported him back to the residence.


The husband was detained for the moment and before speaking with the male he had his rights read to him.


The male stated he was listening to music when Jennifer brought up a girlfriend of his from 20 years ago. When he tried explaining to Jennifer the song he was listening to, he said he had no intention of bringing up old girlfriends.


The male said that is when Jennifer spun out of control. He stated he grabbed Jennifer to prevent her from hurting him or herself and said this happens all of the time. As the husband was telling his side of the story, Deputy Oldham noticed a scratch with fresh blood on the left side of his face.


When the deputy asked if he was hurt anywhere else, he stated that she kicked him multiple times in the genitals and also scratched him on the right arm and across the chest.


Photos of both the husband and Jennifer’s injuries were taken for evidence.


The male continued telling the deputy that Jennifer fell into the tub as he was trying to restrain her. The fight then moved into the living room, where Jennifer began destroying the inside of the home.


The husband decided to leave to stay in a motel to allow things to cool off for the rest of the night. He explained that Jennifer had prior involvement in domestic violence. Deputy Fairey looked up the prior cases and found that Jennifer was the aggressor in the three domestic violence involvements.


With Jennifer at the hospital, Deputy Oldham spoke with Sgt. Hill concerning the evidence gathered. It was determined that Jennifer was the aggressor in this altercation, but due to comments made to the EMS staff, it was decided to place her under arrest and then fill out an involuntary commitment with a certification form.


Jennifer was booked into the Uintah County Jail for the charge of simple assault.


Deputy Oldham asked dispatch to check for prior commitments for possible enhancement, but she was never convicted of the prior three domestic involvements.


Based on the affirmation of Deputy Oldham, the arresting officer, the undersigned magistrate finds that probable cause existed for the arrest without a warrant of Jennifer Louise Borba.


Jennifer Louise Borba may post bail in the amount of $1,080.00.
