On 5/5/24, Deputy Duncan was investigating a possible rape that had occurred was disclosed by Victim 1 that 35-year-old Robert Chester Bird had images of Victim 2 nude chest, who was 15 years old at the time the images were downloaded.
Victim 1 stated there were 12-15 images of Victim 2 nude chest.
On 6/4/24, after Deputy Duncan assisted with a compliance check with Captain Hargis, Robert had been booked into the Duchesne County Jail and a different case. Detective Hunter and Deputy Duncan interviewed Robert in the interview room. Robert had been read the Miranda prior to getting to the jail and confirmed that he was still good to talk to the officers.
Robert Bird is a Registered sex offender charged with unlawful sexual activity with a minor. Robert stated during the interview that he had received 5 nude images of Victim 2. Robert had received these images on Snapchat. Robert said that they were of Victim 2 nude chest. And that she was around 15-16 years old at the time.
Robert claimed not to know who Victim 2 was and said he had broken the cell phone. As soon as he knew how old Victim 2 was, he deleted the Snapchat account and found out who she was.
Robert claimed to have destroyed the images and device upon finding out victim 2 was a juvenile. Robert claimed to have destroyed all images, but this was confirmed to be untrue after the investigation. Robert kept the images of Victim 2, and these are reportedly still on the accounts owned by Robert Bird.
Robert Bird was charged with 5 counts of sexual exploitation of a minor, a 2nd-degree felony.
The current offense is a felony committed while on probation or parole or while free on bail awaiting trial on a previous felony charge. The court finds substantial evidence to support the current felony charge.
Therefore, the court orders that Robert Chester Bird is to be held without bail.
