A Duchesne County Man Throws A Metal Toy Plane At A 7 Year Old Autistic Child

At around 6:30 pm, Cpl. Nichols received a call from dispatch on an assault that occurred in the unincorporated area of Duchesne County.


The complainant reported that her 7-year-old autistic grandson had an object thrown at him by 48-year-old Troy J Montoya, causing injury to the juvenile's testicles. It was believed to be intentional.


Upon arrival, Cpl. Nichols made contact with the juvenile's grandparents, who both stated they had examined the juvenile and confirmed there was swelling and discoloration to the juvenile's testicles. An older juvenile, 8 years old, was also present and reported the incident to their grandparents.


The grandparents consented, allowing the officer to conduct a field interview with the 8-year-old. The 8-year-old juvenile stated that he saw Troy pick up a metal toy plane, which he showed Cpl. Nichols. The metal plane was approximately palm-sized. The 8-year-old said the toy struck the 7-year-old in the groin.


The 7-year-old juvenile was limited in his speech, but he told the officer that Troy had thrown both the earlier-mentioned toy plane and a smaller toy train, both of which he showed me. It was unclear if the toy train struck him, but when asked where the plane hit him, he pointed towards his genital area.


Troy had left the scene but lived down the road on another property owned by the grandparents. There, Troy stayed with his girlfriend, who was also the biological mother of the 7-year-old juvenile but didn't have custody. Troy's girlfriend said she was present for the incident but did not see where or if anything had struck the juvenile.


Troy acknowledged the incident, defending that the juvenile was throwing toys at him, causing him to get annoyed. Troy tried telling the juvenile to stop, but he wouldn't. Finally, Troy said he picked up a crayon and tossed it at the juvenile, hitting him in the nose. Troy indicated he did so somewhat gently. The juvenile began to yell and cry. Troy said he didn't want to antagonize the situation further, so left the scene.


At no time when Cpl. Nichols spoke with the children, who didn't mention anything about a crayon being thrown at the juvenile. Both the 7-year-old victim and the 8-year-old sibling gave consistent testimonies of Troy's actions.


Troy Montoya was arrested and transported to the Duchesne County Jail, where he was booked for one count of child abuse, causing intentional bodily injury, which is a class A misdemeanor. He was also booked in on an unrelated active warrant for his arrest and was later released.
