A 27-year-old male charged with child abuse after assaulting a minor inside a 7-Eleven

On Wednesday afternoon, it was reported that two males were fighting inside the 7-Eleven at 100 North Vernal Avenue. One of the males had gotten into a vehicle and left the area.


When police arrived, the victim stated he was in line to purchase his items when an older man grabbed his shirt and began accusing him of things that happened to his sister. He said the man pushed him toward the soda fountains, not letting him go, continuing to push the victim. The male held the victim with one hand while punching him with the other. The victim stated that an employee intervened and stopped the altercation.


The store employees told Officer Nielsen that the incident started at the cash register. They said a man with a green shirt started pushing the victim, yelling, "Stay away from my sister," while punching the victim.


Officer Nielsen watched the store's surveillance footage. Shortly after 2:51 p.m., a man of larger build wearing a green sweatshirt approached the victim, getting into his face. The male grabbed the victim by the collar of his shirt, shoving him backward from the registers toward the soda fountains.


In the surveillance footage, you can see mostly the male in a green shirt holding the victim and punching him with a closed fist. Due to the camera angle, you can't see details of the fight.


While Officer Nielsen was at the scene another officer located the other male who was involved due to Sgt. Johnstun knowing the male subject.


27-year-old Donavohn Dayce Capps was located at another 7-Eleven at 910 West US-40. Officer Maughan described Donavohn's description to Officer Nielsen, and he matched the male seen in the surveillance footage.


Donavohn stated to Officer Maughan that he was the other male involved in the fight and the one who instigated it.


Officer Nielsen asked Donavohn what caused the fight, and he said that the victim had been saying things to his sister that had gotten him upset. He had even seen him at the high school when he had picked his little sister up from school.


Donavohn told the officer he pushed the victim backward while holding onto his shirt. Donavohn stated that the victim swung at him after he was holding onto his shirt, shoving him. Donavohn stated that he then held the victim under his arm in a headlock-type position.


Donavohn Capps was arrested, transported, and booked into the Uintah County Jail for child abuse, a class A misdemeanor.
