Roosevelt, Utah (4/20/26)—Officer Kearney made contact with 41-year-old Robert Bekenneth Gardner at 392 North State Street, who is a registered sex offender.
The officer was aware that Robert is a registered sex offender and is required to comply with all registration requirements, including maintaining accurate and current residence and secondary residence information.
During a voluntary interview, Robert admitted that he had been staying at Stoneridge Apartments, 158 East 800 South (Apartment G5), for an extended period of time. Robert initially stated he was living there and later clarified that he had been staying there for approximately 6 months following his release from jail.
Robert acknowledged that he is required to check in and notify authorities if any of his information changes. Despite this, Robert admitted that he had not properly updated his address to reflect his residence at the Stoneridge Apartments within the required time frame.
During the interview, Robert provided inconsistent statements regarding his residence, at times claiming he lived with his mother while also admitting to prolonged and ongoing stays at the Stoneridge Apartments. Based on his own statements, Robert had been residing at the apartments for a sustained period without properly updating his registry information.
Based on the investigation, including Robert's admissions and verification of registry records, it was determined that Robert failed to comply with the required offender registry provisions by failing to accurately report his residence.
Under Utah Code 53-29-305(1)(a), an individual commits an offense if the individual knowingly fails to comply with a requirement of the offender registry.
Based on the totality of the circumstances, including Robert's admissions and the evidence obtained, Officer Kearney had probable cause to believe that Robert knowingly failed to comply with the law's registry requirements.
Robert was subsequently arrested for this offense.
