One man threatens another man he is going to “cut his head off with a shovel.”

Uintah County Deputies responded to North Vernal Avenue to a 9-1-1 unknown call. Upon arriving at the scene, the deputies were met by an elderly male who said his girlfriend's nephew had assaulted him.


While police spoke with the man, an odor of alcohol could be detected coming from his person. He became emotional when telling deputies that he had bothered the poor, decent people living down the street.


Deputy Anderton spoke with the nephew, who said he and the elderly man were drinking when they got into an argument. The older man rushed at him, so he took the man to the ground and, on accident, hit him in the mouth.


The neighbor stated the older man then left for his own home.


The neighbor said he followed the man, trying to give him his shoes back, when the older man tripped him, causing him to fall to the ground. He looked up, and the man had a shovel in his hand and threatened to cut his head off with it.


A witness at the scene stated that the neighbor and 71-year-old David Roger Marden were drinking and got into a fight. The witness said David was the instigator of the incident.


David Marden was arrested and transported to the Uintah County Jail.


At the jail, David was advised of his Miranda Warning and agreed to speak with Deputy Anderton about the incident.


When asked about the incident, David stated that he and the victim did not get into an argument, as he doesn't remember what the argument was about. He admitted to rushing at the victim and that the victim put him on the floor of the home. David stated that he walked out of the home and grabbed a shovel, but he did not trip the victim.


David stated that he did tell the victim he would cut his head off while holding the shovel and that he wanted to look intimidating.


During questioning, David stated that he would be out of Utah once he could use the phone and reach his sister. For this purpose, Deputy Anderton is asking for a no-bail hold.


The current offense is a felony. The court finds substantial evidence to support the charge and finds clear and convincing evidence that David Roger Marden would constitute a substantial danger to any other individual or to the community or is likely to flee the jurisdiction of the court if released on bail.


Therefore, the court ordered that David Roger Marden be held without bail.
