The complainant reported that his daughter had received messages from a female saying that her boyfriend had beaten her up and she was hiding in the bushes near her residence.
When Officer Escobedo arrived, he wasn't able to find the victim. The call notes indicated that the victim wasn't willing to cooperate with law enforcement.
The victim's boyfriend was later identified as 39-year-old Timothy O’Brian Hester through the familiarity of prior law enforcement involvements. It was also found during this investigation that there was an active Pre-Trial Protective Order in place between Timothy and the victim.
It should be known that prior to the incident, Officer Escobedo was given a suspicious detail where an individual reported he had given a ride to a male who had been in a "heated" conversation with a girlfriend on the phone and dropped him off near the victim's residence.
The individual described the man he gave a ride to as being African American, wearing a black shirt and jeans, and having tattoos on his forearms. He reported the male subject was an "out of towner" visiting his girlfriend.
While patrolling, Officer Escobedo found an African American male walking South in the area of the victim's residence wearing a hoodie that had dark-colored sleeves and a lighter-colored, patterned torso similar to camouflage or a geometric pattern.
Officer McGaha with the Naples Police Department made contact with the victim and convinced her to meet with officers.
Timothy was located and found to be in violation of his probation and was taken to the Uintah County Jail for a 72-hour hold.
As the officer spoke with the victim, he observed that the left side of her top lip was swollen and red, consistent with being hit in the mouth. She also had slight bruising on the corner of her right eye.
Timothy confirmed he had been walking in the area of the victim's residence but denied seeing or talking to her.
The current offense is a felony committed while on probation or parole or while free on bail awaiting trial on a previous felony charge. The court finds substantial evidence to support the current felony charge.
The current offense is a domestic violence offense. The court finds substantial evidence to support the charge and finds clear and convincing evidence that Timothy O'Brian Hester would constitute a substantial danger to an alleged victim of domestic violence if released on bail.
The current offense is a Protective Order Violation. The defendant cannot be released until they see a judge. The defendant must be seen in person or by video before the court or a magistrate within one judicial day after the day on which the arrest was made.
Therefore, the court orders that Timothy O'Brian Hester to be held without bail.
