Vernal, Ut.- Between August 1, 2006, and August 31, 2006, in Uintah County, Tyson Charles Collett, and the victim were camping. Tyson pulled off the victim's pants and told the victim he wanted to have sex with her. The victim told Tyson ''no,'' but he did it without her consent.

Between November 1, 2008, and November 30, 2008, in Uintah County, Tyson, and the victim separated after dating. The parties were living in the same residence on opposite ends of the home. Tyson came into the victim's room and asked for sex. The victim told him ''no'' because they are separated, and she is not on birth control.

Tyson got on top of the victim, took off her clothes, and forced sexual intercourse on the victim. Afterward, the victim went to the bathroom and cried. She became pregnant nonetheless as a result of the assault.
