A man chokes a child over a power outlet being unplugged

Duchesne, Co.- On 9/14/22, a Duchesne County Deputy was dispatched to a home regarding a domestic violence situation. When the Deputy arrived, he spoke with two victims and one witness.

All three of them stated that the suspect, 33-year-old Devan James Kearney, had gotten into a verbal argument with the child regarding an outlet that Devan had unplugged. The child called Devan a name, and Devan grabbed the child around the neck, putting him in a chokehold.

Devan threw the child to the ground, holding him down in the choke hold. The child started calling out for help because he feared he would go unconscious or die.

The adult female jumped in and pulled Devan off the child, pushing him down the hallway and away from the child. She tried to keep Devan away from the child and in the back room.

Devan started pushing and hitting the female to get to the child. All three stated that the female and Devan had been drinking all day.

There were injuries on the child and Devan that were consistent with what was being reported.

Devan told the Deputies that he had put the child into a choke hold and admitted to drinking.

Devan has a continuing and escalating history of violence with the victims by his own admission. Devan was transported to the Duchesne County Jail.
