Roosevelt- Cpl Barton was patrolling US-40 on December 8th, 2023, and saw a red passenger car traveling eastbound inside Roosevelt City limits with a smashed windshield.
A traffic stop was performed on the red car at 2000 W US-40. Cpl Barton informed the driver that his windshield was damaged and needed to be fixed due to the severity of it being smashed.
The driver's information was gathered and run through dispatch. The driver was identified as 66-year-old Frank Dana Russell.
While the officer was in his patrol vehicle, he noticed Frank moving around inside his car, acting like he was trying to hide something. Cpl Barton returned to speak with Frank and asked him about his moving around and if there was anything illegal inside his vehicle, and Frank said no.
Officer Knight was called to assist with his state-certified narcotic detection K9 while Cpl Barton finished his investigation. Officer Knight arrived, deployed his K9, and then advised Cpl Barton that there was a positive indication.
Frank was spoken to about the positive indication and informed that his car was going to be searched, and he was asked if there were any illegal drugs inside his vehicle. Frank was asked to empty his pockets, and he reached into his front pockets and kept his hand inside his pocket. Cpl Barton asked him to remove his hands from his pockets, but he was still hesitant.
Frank said he had a THC vape cartridge and pulled it out of his pocket. Frank was asked to hand it over to Cpl Barton, but he wouldn't. Frank was asked again, and he refused to cooperate. Frank tensed up and pulled away from the officers. They gave him commands to give up the THC cartridge, and he still refused.
Both officers tried detaining Frank, and he began to resist arrest. Frank was escorted to the ground, but not before he was able to place the THC cartridge in his mouth and swallow it when the officers were attempting to put him in handcuffs.
Frank was transported to the UBMC ER to get the THC cartridge out of him. Frank was later released and transported to the Duchesne County Jail.
