A Male That Raped A Female Goes Back To Court For Restitution

Vernal, Ut.- On 10/15/19, Vernal dispatch advised of an unknown problem in Uintah County. While en route Deputy Watkins spoke with the complainant, who lived across the street from the unknown problem.

The complainant said she received a text message from her neighbor stating she needed help, and to call the cops. According to the complainant, the victim's husband, 36-year-old Andrew Philip Schaaf was at the home and has a history of violence.

Deputy Watkins and Officer Gray with Naples City Police arrived on scene and knocked on the front door without a response. They could see lights on in the house and walked to the area of bedrooms where they could hear a female calling for help two separate times.

The Deputy and the Officer made entry into the home, where they could hear a female in distress. The door leading into the bedroom was locked. They forced the door open, where they saw Andrew raping a female.

Andrew was ordered off the bed and detained. The emotional female was removed from the room.

Deputy Watkins conducted a field interview with the victim, and during this interview, she said Andrew dropped the kids off this evening, and they had a few drinks. The victim told Andrew he had to leave because she was tired.

Andrew pulled her into the bedroom, removed her clothes, and proceeded to have sex with the victim forcibly. Andrew was making verbal threats to kill her and her parents. The victim made these statements to the Deputy, and she told Andrew to stop, but he continued to have forcible sex with her.

The victim asked permission to use the bathroom, and Andrew allowed her to do so. While in the bathroom, the victim texted her friend to call the police.

Andrew told the victim he was going to have sex with her and proceeded to choke her out to the point she passed out. The victim said she was trying to fight back, but Andrew was behind her and had his arms around her throat and chest. Andrew made the statement, "She owed him."

The victim stated that she told Andrew no or to stop, but he used force and proceeded to have sex with her just before Officer Gray and Deputy Watkins entered the home.

The victim had visible marks on her face, neck, and chest area consistent with being assaulted and choked. She was transported to the hospital after the interview.

Deputy Watkins issued Andrew his Miranda Rights, which he indicated he didn't understand, and was acting as if he was passed out, and no questions were asked.

Officer Gray spoke with the victim at the hospital about the children being witnesses to this incident. She advised that her daughter came into the bedroom when Andrew was assaulting, choking, and raping her. Andrew removed the little girl from the room. This would explain why the bedroom door was locked.

Andrew was arrested and booked into jail for rape, forcible sodomy, aggravated assault, and domestic violence in the presence of a child.

Andrew Philip Schaaf's bail was set at $100,000.00
