Officer Adams with the Roosevelt Police Department was dispatched to a residence in the area of 700 East 300 North, near East Roosevelt Elementary School, of a report that a man was growing marijuana in his yard.

The officer arrived and could see what looked like marijuana from the complainant's backyard.

An officer with the Drug Task Force arrived and confirmed that it was marijuana.

Officer Adams knocked on the door of the residence that the marijuana was in, and 76-year-old Danny Lee Cooper opened the door.

The officer told Danny that he could see and smell his marijuana plants in his backyard. Danny stated he was growing them for medicinal purposes. He was then asked how long he had been growing them, and Danny said just this summer.

Officer Adams had Danny stop answering questions until his rights were read. Danny was placed under arrest, and the officer read him his Miranda Rights and continued asking Danny questions.

Danny stated He stated that he did not have a medical marijuana card and that he did not have a license to grow them. He was asked if it was CBD, and Danny told Officer Adams that it was hard to grow just CBD and stated that it probably had THC in it.

Officer Adams asked if he was giving it to other people, and he stated that he would when they asked.

A search warrant was approved to search the residence. When searching the residence, the officers found three small marijuana plants and four large plants growing in the backyard.

When they searched the house, there was an entire room full of marijuana and processing equipment for use and distribution.
