At approximately 3 am, Vernal City Police were called on a report of a male subject trying to get into their home. The caller stated he kept ringing the doorbell and trying to open the front door.
While the police were en route, the caller stated that the subject had left and didn't know where he went but gave a physical description.
Sgt. Watt arrived and didn't see anyone in front of the original address but saw several people on the front porch of another duplex four building west. The officer noticed one of them walk out to a cab that had just pulled up.
Another individual on the porch pointed toward the man walking to the cab, then went back into the home. The officer made contact with the male individual and began talking to him to see if he was the person he was looking for.
While Sgt. Watt was walking toward this person, an assisting officer heard yelling and commotion of a fight starting at the back of the original address on 400 South. Officers ran to the back of the residence and saw two males wrestling and yelling.

The two were separated, and Sgt. Watt began speaking with one of the males, identified as 22-year-old Toby Chase Kirby.
Toby stated he was at an "after party" and was kicked out. He said he had been at the apartment for the after party for about an hour after a friend dropped him off there. Toby had red, droopy eyes and slightly slurred speech, and his statements did not seem to fit what was happening. He did not know why the people were fighting with him other than to get him out of their house.
An assisting Officer spoke with the other male involved in the fight and the bystanders. He was informed that Toby was the person trying to get into the original complainant's house. It was discovered that after he left the original complainant's porch, he walked over to the next adjoining unit's front door and went inside. It was determined that the "fight" was the occupants of the second duplex trying to get Toby out of their house.
Toby was taken into custody without incident and submitted to a portable breathalyzer to determine his alcohol content and whether a medical clearance was necessary before booking him into jail. The breath test results were a .204 BrAC.
It was later determined that the "after party" that Toby originally went to was two duplex units west of where the trespass incident occurred, and Toby didn't realize he had walked into the wrong duplex building.
