Police respond to Neola on a report of a possible burglary

At 8:00 am, Deputy Clyde with the Duchesne County Sheriff’s Office responded to the Neola area on a report of a possible burglary.
The reporting party told the deputy he saw a male go to a residence that had been vacant for a couple of months. The suspect appeared to be trying to enter the home by checking the front door and windows to see if they were unlocked.
As the caller was describing the male to the deputy, the caller pointed and said, “That’s him, right there!”
Deputy Clyde spoke to the male, who identified himself as 41-year-old Alban Gary John.
When asked about going to the residence, Alban explained that he wanted to get into the backyard to “hit the punching bag.”
Alban gave Deputy Clyde an ID card and had dispatch run a warrant check. Dispatch stated that he had an outstanding Statewide Warrant for his arrest for possession or use of a controlled substance and possession or use of drug paraphernalia.
Alban was placed under arrest for the warrant and searched for weapons. During the search, Deputy Clyde found a glass pipe with a crystal-like substance inside of it consistent with methamphetamine in his front pocket.
As the search continued, the deputy found two more glass pipes in Alban’s pockets. One of those pipes contained burnt marijuana. Deputy Clyde asked Alban about the pipe, and he told him that he just uses it to smoke weed.
A criminal records check showed Alban had two previous convictions for dangerous drugs in the last ten years. This enhances the possession charge of methamphetamine from a Class A Misdemeanor to a Third Degree Felony.
Deputy Clyde transported the prisoner to the Duchesne County Jail and booked on the charges above.
Because Alban is an enrolled tribal member, the courts believe he is a flight risk and would likely return to the reservation, where the Sheriff’s Office doesn’t have jurisdiction.
Based on the affirmation of Deputy Clyde, the arresting officer, the undersigned magistrate finds that probable cause existed for the arrest without a warrant of Alban John.
The current offense is a felony. The court finds substantial evidence to support the charge and determines that there is clear and convincing evidence that Alban John would pose a substantial danger to any other individual or the community or is likely to flee the jurisdiction of the court if released on bail.
Therefore, the court orders that Alban John is to be held without bail.
