Yesterday, Cpl. Nichols was patrolling in the Hancock Cove area when a vehicle approached him at what appeared to be a high rate of speed. The officer activated and locked his radar onto the only vehicle, which read 122 MPH.
The officer activated his emergency equipment and stopped the vehicle near 400 North 3000 West.
Cpl. Nichols made contact with the vehicle's sole occupant, who was identified as 26-year-old Roberto Lorenzana Guerrero.
While the officer spoke with the driver, he could smell the faint odor of alcohol. His eyes were red and glossy, and his speech was slow and slurred.
When asked for his license and registration, Roberto grabbed what initially appeared to be a debit or credit card. He caught the mistake before handing it to the officer and then retrieved his driver’s license.
Upon the officer asking again for the registration, Roberto retrieved a stack of papers from the glove box. He had difficulty going through them as his hands were slow and clumsy, dropping papers onto the floorboard.
Cpl. Nichols asked Roberto how much he had to drink, and he responded, “Two beers.”
Roberto was asked to exit the vehicle to perform the field sobriety test. Upon doing so, Roberto was hesitant to perform the tests, indicating he couldn’t pass them. He stated he was alcohol restricted, knowing that any drop of alcohol could count as a DUI.
The officer advised him that if he could pass the field sobriety tests, it would benefit him, and Roberto agreed to complete them.
After the tests were complete, it was clear to Cpl. Nichols that Roberto was driving with at least some alcohol in his body and that he was well over the legal limit to drive, with PBT results showing .0132.
Roberto Guerrero was placed under arrest and placed in the patrol vehicle while the officer investigated further.
Cpl. Nichols searched the vehicle and found an open container of alcohol on the passenger side floorboard in the back. The beer can was still cold and approximately ¾ full.
The vehicle also didn't have an ignition interlock device, which the officer confirmed through Uintah County that he was required to have. Roberto's driver's license was suspended, and his car was impounded.
Roberto was transported to the Uintah Basin Medical Center where he submitted to a blood draw with results pending. He was then taken to the Duchesne County Jail, where Cpl. Nichols discovered Roberto had a DUI within the last 10 years and is still on probation for a DUI conviction.
Roberto is being charged with:
DUI 2nd offense, a class A misdemeanor, open container, class C misdemeanor, no ignition interlock installed, a class C misdemeanor, reckless driving, a class B misdemeanor, and driving on a suspended driver's license, a class C misdemeanor.
