Police Find Information On A Probationer Phone About Dealing Drugs

At around 5:00 p.m., Cpl. Nichols with the Duchesne County Sheriff's Office was asked to assist AP&P agents who were going to execute a manhunt for one of their probationers. The probationer was believed to be staying at a residence located at 1076 West 9000 North, outside of Neola City.
During the search for the individual, information was found on a probationer's phone between him and one identified only as "Ty." The phone conversation indicated the probationer was telling Ty that he had some "black and pills" available, and some "black" means black tar heroin.
The residence occupants told Cpl. Nichols that Ty was outside working in the pickup's engine compartment in the driveway.
The officer approached the male and asked for his ID. The male ignored the officer by burying his face deeper into the engine compartment with his feet in the air.
The male first asked Cpl. Nichols why he needed his name, to which the officer replied there was a concerning conversation via text messaging between the male and the probationer.
The male was asked several times for his name. He finally identified himself as Tyrel Miller on 5/8/1986. When Tyrel was run through the system, it was not the same person in the driveway. The male subject was later identified as 37-year-old Richard Tyrell Potter, who had three active warrants for his arrest.
Richard was taken into custody, and while doing so, one of the AP&P agents checked underneath the truck Richard was working on, and on the ground was a small baggie of meth directly where Richard was working.
Richard admitted that he uses meth but said he had not used it for a few days. When the officer checked his criminal background, Richard's history showed a significant amount of drug history, and the residence they were at was a known drug house.
Richard denied the baggie of meth found underneath the truck was his.
Richard Tyrel "Ty" Potter was arrested and transported to the Duchesne County Jail, where he was booked on the three mentioned warrants in addition to possession of a controlled substance, a class A misdemeanor, and giving false personal information to a peace officer belonging to an actual person, a class A misdemeanor.
Based on the affirmation of Cpl. Nichols, the arresting officer, the undersigned magistrate finds that probable cause existed for Richard Tyrell Potter's arrest without a warrant. Richard Tyrell Potter may post bail in the amount of $10,000.00.
If Richard Tyrell Potter posts bail as stated above, Richard Tyrell Potter is hereby ordered to be released subject to the following conditions:
• Promise to appear for all required court proceedings
• Promise to not commit any criminal offense
• Report your contact information and any change in address, phone or email to the court and your attorney within 1 business day of the change
• 4th Amendment Rights Waiver in agreement
• Fee: $250 (per month)
• GPS ankle monitor
• Random drug testing (up to 3 times per week)
• Warrant amount for failing to call in: $100 (per month)
• Appear in court when required
• Commit no new offenses during the period of release
• Defendant shall forfeit or refrain from possession of a firearm or other dangerous weapon.
In those jurisdictions where pretrial release and supervision authority have been granted by written agreement, defendants may be released to pretrial services without posting bail, consistent with the terms of that agreement.
