Officer Escobedo responded to a call concerning an adult male who was intoxicated and was passed out.
While on scene, the male was identified by Cpl. Ross as 32-year-old Marty Brian Burr, who he recognized from previous incidents.
Marty stumbled as he walked and spoke with thick, deliberate, slurred speech. As the officer spoke with Marty, he was having a hard time understanding Officer Escobedo’s questions.
When Sgt. Roth spoke to Marty's mother, she stated that Marty had injured himself in the mouth with a fork and then rubbed the bloody fork on the wall.
At this time, Cpl. Ross asked Marty if he knew what day it was. He stated that it was Tuesday, September 2nd. Marty consented to a PBT (Portable Breath Test). The results of that test were .379 BrAC (breathe alcohol content).
While at the jail, Marty submitted to another PBT. The results of the second test were .320 BrAC.
Due to his self-inflicted injury and his lack of awareness of what day it was, it was determined by Officer Escobedo that Marty was under the influence of alcohol to the degree that he may endanger himself or another in his home.
