Man from Indiana arrested for aggravated assault for pointing a firearm at his girlfriend

Deputy Oldham received a call from dispatch that a male subject was pointing a firearm at a female as she was running across the yard.
The deputies arrived and met with the female victim, who they asked to speak with them outside. She was extremely emotional and had to be escorted outside.
Vernal Police kept knocking on the door when 37-year-old Timothy Jadon Williams came to the door, and Vernal Officers immediately placed him into handcuffs.
Deputy Oldham asked the victim about the firearm, and she stated that Timothy doesn't have a firearm, but she owns one that is normally kept inside a drawer.
The deputy then spoke with Timothy, and he stated he and the victim were arguing, and during the argument, he pointed the gun at her, not realizing that he had the gun in his hand.
The victim gave the police consent to enter the home and retrieve the firearm, but It was decided to apply for a search warrant instead.
While waiting to get the search warrant approved, Deputy Oldham spoke with Timothy again. Timothy began saying he was hanging out inside the shed when the victim came out and seemed upset. Timothy pulled the gun off his hip, where he said he always keeps it for safety.
Timothy continued by saying he pointed the gun at the victim but was going to throw the magazine at the dog due to it barking. He then stated after the argument, he took the firearm inside the residence and placed it back inside the dresser.
The deputy asked Timothy why he took the gun inside the residence and not back in the holster on his hip because he said he always carries the firearm with him. Timothy said he put the firearm up before any law enforcement began banging on the front door. When asked to clarify what he meant, he said he wasn't stupid and knew the police were going to arrive, and made the comment, "because it was due to him being black."
Deputy Oldham explained to Timothy that he was being placed under arrest and would be taken to jail.
The victim told Deputy Oldham that Timothy is always getting mad and makes comments about “because he is black.” The victim seem scared when speaking about Timothy. When the deputy explained that Timothy was being arrested, she kept making comments that she didn't want to press charges.
Deputy Oldham performed a records check on Timothy, which revealed that he had been convicted four times of felonies in the state of Indiana.
Once the search warrant was approved, three officers entered the home to search the residence. The firearm was located, and a safety check was conducted. The gun was unloaded, but there was a full magazine still in the gun.
Timothy was booked into the Uintah County Jail for aggravated assault due to his pointing the firearm at the victim during an argument and possession of a dangerous weapon by a restricted person.
