At 7:00 p.m., agents with AP&P asked the Naples Police Department for assistance on a field visit. Upon the agents' arrival, a female ran to the back of the camper, and the probationer ran out of the camper and was apprehended in the neighbor's yard.
When Officer McGaha arrived, he was met by a male probationer from multiple previous interactions with him, he recognized the male as 42-year-old James Alfred Gates. The officer had also met the female in related calls with James. She was identified as 34-year-old Shantell Katheryn Seeley.
Agent Ercanbrack was performing his checks in the 5th-wheel camp trailer when Officer McGaha walked inside to talk with the agent. When the officer entered the camp trailer, he was overtaken by the odor of freshly burnt methamphetamine.
Agent Ercanbrack showed the officer a pink glass pipe in a drawer in the back of the camper. This is the same area he observed Shantell run toward.
Officer McGaha found a methamphetamine glass bulbed pipe that had white powder inside with a burnt glass bowl at the end. This pipe had been used to ingest methamphetamine on multiple occasions.
The officer asked Shantell about the findings, and she stated it belonged to James. She was asked when the last time she smoked meth out of that pipe, and she said about five weeks ago. Shantell stated James purchased it at that time.
Officer McGaha began to think Shantell appeared to be attempting to distance herself from the meth pipe.
Officer McGaha proceeded to interview James, who was handcuffed and sitting in the back of the AP&P vehicle. He informed James of his Miranda Rights, which he understood, and wanted to speak with the officer.
When asked about the meth pipe, he stated he doesn't smoke meth. He injects it. Officer McGaha asked James to exit the car and observed fresh needle track marks on his right arm. James was asked about the pink meth pipe, and he stated it was Shantell's because he couldn't smoke due to medical issues and said he would take charge of this if needed.
Officer McGaha stated this is not how it worked.
Every time Officer McGaha had an interaction with narcotics or an arrest with James, he never had a pipe on his person. He stated he only uses points (Needles).
The office informed Shantell of her Miranda Rights, and she said she understood and continued to answer Officer McGaha's questions. He told her about the pipe and informed her of James' answers, she stated she had smoked out of it recently and said James had also smoked out of it recently.
Shantell Seeley was booked into the Uintah County Jail for Possession of a controlled substance, meth, and possession of paraphernalia.
Officer McGaha performed a criminal history on Shantell who did not have a long history of narcotics use.
Based on Officer Mcgaha's affirmation, the arresting officer, the undersigned magistrate finds probable cause for Shantell K Seeley's arrest without a warrant. Shantell K Seeley may post bail in the amount of $2,500.00.
