Female arrested for bitting and whipping her boyfriend with a necklace

Vernal City Police were dispatched to the East Meadows trailer court at 126 North 500 East, Vernal, Utah.


It was reported that 28-year-old Kelby Marion Daniels was throwing the victim’s items around and “freaking out.”


When the police arrived, Cpl. Ross spoke with Kelby, who he recognized from previous incidents, who stated she was assaulted by the victim, who was her boyfriend.


The officer didn’t observe any injuries correlating to Kelby's allegations of being assaulted.


While Cpl Ross spoke with Kelby, he noticed the heavy odor of alcohol emitting from her person. She would slur her words, had difficulty maintaining balance while standing, and had to be told to sit down multiple times after almost falling.


The officer then went and spoke to the victim, who stated he was bitten multiple times after she pulled him on top of her. He said Kelby then ripped his necklace off and used it to whip him on the back.


Cpl. Ross saw several marks on the victim's right arm, and on the left side of his back were welts that matched the size of the necklace.


The victim stated he was able to separate himself from Kelby by leaving the area. After leaving, he received a message from Kelby showing a laceration on her hand from throwing his items around the house.


The victim requested that he come back to check on her, and after arriving at the residence, Kelby began punching the victim in the face. He said he was going to leave again, but Kelby grabbed onto his jacket, which caused it to rip.


The victim went out to his vehicle, and Kelby started hitting him again. He said this happened several times until he was able to get away from her, but due to her actions, the victim was unable to leave.


Later, the victim was able to show an assisting officer the damage to the wood floor where Kelby was throwing gym weights in the living room.


Cpl. Ross spoke to Kelby about the information he gathered from the victim about the multiple assaults. She stated that she tried to grab the victim’s face but grabbed the necklace. Kelby was unsure if she had hit the victim with the necklace, but it was possible.


When asked if she bit the victim, she stated, "Very well might have." She said she didn't want him to leave when she grabbed the victim's jacket.


While the officer was speaking with Kelby, he noticed that her story had changed multiple times.


Kelby was informed that she would be arrested for domestic violence and was placed in handcuffs.


While en route to the jail, unprovoked, Kelby stated that Cpl. Ross only wanted to arrest her "because I fucking bit him!"


Kelby was transported to the Uintah County Jail to be booked on charges. While at the Jail, Kelby consented to a PBT, and the results of that test were .138 BrAC.


Based on the affirmation of Cpl. Ross, the arresting officer, the undersigned magistrate finds that probable cause existed for the arrest without a warrant of Kelby Marion Daniels.


Kelby Marion Daniels may post bail in the amount of $2,400.00.


If Kelby Marion Daniels posts bail as stated above, Kelby Marion Daniels is hereby ordered to be released subject to the following conditions:


•Promise to appear for all required court proceedings

•Promise to not commit any criminal offense

•Report your contact information and any change in address, phone, or email to the Court and your attorney within 1 business day of the change

•Complete Pretrial Supervision intake appointment within 72 hours after jail release

•Receive hearing date reminders

•Report for Drug Screening 1x per week if indicated by probable cause and/or assessment

•Report in person 2x per month for supervision appointment

•Report to Pretrial Supervision immediately after jail release


In those jurisdictions where pretrial release and supervision authority have been granted by written agreement, defendants may be released to pretrial services without posting bail, consistent with the terms of that agreement.
