Female Arrested At The Vernal Gardens Apartments For Domestic Violence

Officer Nielsen was dispatched to 342 South 1350 West to the Vernal Gardens Apartments to a report of a physical altercation that was occurring. The incident was reported by a minor of the residence who ran to a neighbors.
When the officer arrived at the residence, he knocked on the door and was met by 40-year-old Delilah Maryboy, who had drops of blood across her face and chest. Delilah exited the residence, stating that her boyfriend was still inside.
Officer Nielsen called for the male to come to the door. When he came into view, he had blood on his face.
The officer started his investigation by speaking with Delilah about what had occurred. Delilah stated that she and her boyfriend had been arguing when she got upset. Delilah then stated that she struck him in the face. While speaking with Delilah, the officer noticed a bruise on her left arm. Delilah stated that it was from her son trying to stop her from hitting her boyfriend.
Delilah stated this was when her son left the residence. While speaking with Delilah, Officer Nielsen could smell the odor of alcohol coming from her person. Delilah said she had eight beers to drink earlier. Delilah stated that she and her boyfriend were dating and lived at the residence together.
Officer Nielsen placed Delilah into handcuffs and secured her into the patrol vehicle. Delilah willingly submitted the results of a Portable Breath Test, with a result of .271 BrAC.
Due to Delilah's alcohol level, she was transported to Ashley Regional Medical Center for a medical clearance. Delilah was admitted to the hospital for a period of time due to some blood tests. The attending physician later cleared Delilah.
Based on the affirmation of Officer Nielsen, the arresting officer, the undersigned magistrate finds that probable cause existed for the arrest without a warrant of Delilah Maryboy.
Delilah Maryboy may post bail in the amount of $2,000.00.
Delilah was secured into the patrol vehicle and transported to the Uintah County Jail to be booked on the charges of:
Assault Domestic Violence-Enhanced
Domestic Violence in the presence of a child
Intoxication
If Delilah Maryboy posts bail as stated above, Delilah Maryboy is hereby ordered to be released subject to the following conditions:
• Promise to appear for all required court proceedings
• Promise to not commit any criminal offense
• Report your contact information and any change in address, phone, or email to the Court and your attorney within one business day of the change
In those jurisdictions where pretrial release and supervision authority have been granted by written agreement, defendants may be released to pretrial services without posting bail, consistent with the terms of that agreement.
