Dispatch received a call about a domestic violence situation where the caller stated that the victim had been attacked by her boyfriend, 24-year-old Joseph Paul Rivera, who was keeping her from leaving the home.
While dispatch was talking to the complainant, the line got disconnected.
When Deputy Smith arrived at the scene, he knocked on the door, which opened on its own. The deputy announced himself and heard screaming and yelling.
Joseph walked out of the room, asking what the officer was doing there. Deputy Smith walked up to Joseph and saw the victim sitting on the bed crying. There were blood stains on her sweatshirt, and the deputy detained Joseph, took him out, and put him in his patrol vehicle.
While the deputy spoke with the victim, it was learned that Joseph had pinned her down in the bathroom, covered her mouth, making it hard for her to breathe, and then slammed her head against the floor.
The victim bit and scratched Joseph until he let her go and ran to the bedroom, where she called a friend, asking her to come to pick her up. Joseph went into the bedroom, took the phone, and hung it up. He kept her phone until the police arrived.
While the victim was trying to leave the bedroom, Joseph would pin her down and block the door, preventing her from leaving.
The victim told Deputy Smith that Joseph had been drinking throughout the day and consumed between 8-10 beers.
Joseph was arrested and booked into the Duchesne County Jail.
