An intoxicated male takes car without asking and gets a DUI

Officer Murray responded to a report of a stolen vehicle. The car's owner stated he believed his tenant, 54-year-old Samuel Scott Lund, had taken his Buick Lesabre.
The owner said Samuel has only been allowed to take his vehicle twice, once a month ago and once a month before that. The owner stated that Samuel didn’t have permission to take his car this evening.
On 1/11/25, Cpl. Randall saw a vehicle matching the description of a stolen car in the parking lot of 7-Eleven on 100 North Vernal Ave. The officer noticed that the brake lights on the vehicle were on and saw an individual in the driver's seat.
The officer pulled the car over because it matched the description of the vehicle that had been reported stolen.
Cpl. Randall contacted the driver and sole occupant, Samuel Lund. Samuel stated he didn't have his driver's license with him and that the car belonged to his roommate.
The officer requested that Samuel exit the car and perform a records check. The records check revealed that Samuel had one active statewide warrant and a suspended Utah driver's license.
Other Vernal City Police Officers confirmed that the vehicle Cpl. Randall stopped was the reported stolen vehicle. The officer asked Samuel if he had anything to drink that night. He stated he had not drunk anything that night but did during the day. Samuel stated his last drink of Vodka was approximately 6 to 7 hours before the traffic stop. He said he drank approximately one pint of Vodka.
Samuel was placed under arrest and transported to the Uintah County Jail, inside the Sally Port Cpl. Randall asked Samuel if he would conduct Standard Field Sobriety Tests. The SFSTs were conducted on a dry, flat concrete surface that was clear of obstructions.
After the tests, the officer determined Samuel was under the influence of alcohol to a degree that rendered him unsafe to operate a motor vehicle.
Samuel submitted to an Intoxilyzer test. The intoxilyzer test resulted in a BrAC of .186.
Samuel had been convicted of a DUI once in the last ten years. Based on the previous conviction, the count of driving under the influence was enhanced by one degree.
During the interview at the jail, Samuel stated he had repeatedly taken the car after the owner had gone to bed but understood why he called the police, as he did not have permission to use the vehicle.
