Cpl. Ross responded to the address of 145 West Main Street after the complainant reported that a Native American female came into the store and sat down on a couch. It was also reported the female appeared to be under the influence of an illegal substance, was in a daze, and was picking at her teeth.
When the officer arrived, he found the female sitting on a couch near the entrance, who was identified as 29-year-old Allison Ellen Jones.
Allison was seen sitting next to multiple bags with no one else around. Cpl. Ross conducted a local check and found Allison had one active Board of Pardons warrant. As he spoke with Allison, he noticed she appeared to nod off, and her eyelids would close and then open repeatedly.
Allison was chewing on her right hand while she spoke with the officer. Allison had slurred speech and would zone out throughout their conversation. Based on the officer's training and experience, this behavior can be associated with individuals under the influence of an illegal narcotic.
Cpl. Ross noticed Allison had a piece of tin foil in her hand, and when he requested to see it, she handed it to him. In a small corner of the tinfoil, there was a burnt residue that was consistent with pills being ingested. At this time, the officer informed Allison that she would be under arrest for the warrant, and she was placed in handcuffs.
While conducting a search, a white paper-like bag with a leafy substance appeared and smelled like bud marijuana.
While searching through the other bags, which were seen next to Allison, a broken glass pipe was found in a Crown Royal bag. The bags also contained cards and ID's with Allison's information. The pipe had a white crystalline substance inside that was consistent with methamphetamine. An unopened Budweiser can was also found in one of the bags.
Cpl. Ross conducted a records check and found Allison was placed on probation for 24 months from June 2023. During this period, she was not to be in possession, purchase, or drink alcoholic beverages. Based upon the seized contraband, items holding the illegal contraband, the alcoholic beverage.
While conducting a criminal history check, it was found Allison had multiple convictions for previous possession of illegal substances, including marijuana. This enhanced the Possession of Methamphetamine to a Third Degree Felony and the Possession of Marijuana to a class A Misdemeanor.
Based on the affirmation of the arresting officer, the undersigned magistrate finds that probable cause existed for the arrest without a warrant of Allison Ellen Jones.
The current offense is a felony committed while on probation or parole or while free on bail awaiting trial on a previous felony charge. The court finds substantial evidence to support the current felony charge.
Therefore, the court orders that Allison Ellen Jones is to be held without bail.
