Whiterocks, Ut.- On the evening of 6/5/23, Uintah County Deputies, BIA, and AP&P responded to the area of 10165 North 5500 East in Whiterock, Utah, on a report that 35-year-old Dustin Joseph Nielson was staying at this residence.
It was said Nielson was driving a Buick passenger car that was red and gray. Information was obtained that Nielson wasn't going to prison and would shoot it out with the police.
Nielson's Buick was seen in the driveway at the above address and was wanted on ten arrest warrants. Several of them were felony offenses. Nielson was also wanted by AP&P, who he is currently under their supervision.
Nielson's Buick was seen leaving the residence and heading South on 5500 East near 9800 North. Nielson drove passed Deputy Watkins.
Watkins activated his emergency lights and pulled in behind Nielson's Buick. Nielson continued to accelerate, Deputy Watkins activated his siren, and the Buick continued speeding away.
Shortly after the pursuit, assisting Deputies deployed road spikes disabling three of the vehicle's tires, but the vehicle continued to evade the police. Nielson was driving on the wrong side of the road.
Nielson approached the intersection of 7500 East SR-121, running the stop sign and continuing through the intersection at around 40 mph. A few miles down the road, the Buick came to a stop, and Nielson, along with two other occupants, was taken into custody without further incident.
Because Nielson was on supervised probation with AP&P, a search of his vehicle was conducted.
On the driver's side floorboard was a pink cloth case that contained a tutor straw with heroin residue and used syringes with residue. A clear liquid was in one of the syringes, and several syringes were used differently. Deputy Watkins suspected the liquid residue was methamphetamine.
Also, inside this case was a glass tube with heroin residue. In the center console was a marijuana pipe.
The right front passenger, 33-year-old Gilford Tom Yazhe, was arrested and found to possess heroin and Oxycontin.
In an interview with Yazhe, while under Miranda, he admitted that when the vehicle was pursued, Nielson handed him a baggie containing black tar heroin and Oxycontin pills. Nielson told Yazhe to get rid of it by tossing them out of the vehicle.
The location where the heroin and pills were found on Yazhe was in his shoe. Yazhe also admitted Nielson gave him these illegal drugs, and he placed them in his shoe.
The drug charges were enhanced because of Nielson's prior criminal history that involved illegal narcotics. Also, his driver's license was suspended.
While at the Uintah County Jail, Nielson was advised of his Miranda Rights, and he told Deputy Watkins he wanted to speak with him later when he was not so "fucked up."
No other questions were asked at this time, and an interview will be at a later date. At no point did Nielson ask for an attorney. He just wanted to wait until he felt better before speaking with Deputy Watkins.
