A Uintah County Man Stopped For DUI With Juveniles Inside The Vehicle

| Naples, Ut. | April 20th, 2024 |


A Naples City officer was patrolling northbound on 1500 East when a white SUV in front of him crossed over the white fog line with almost half the vehicle.


A traffic stop was initiated near 775 South 1500 East.


Officer McGaha approached the vehicle, and in the back, he saw multiple containers of Coors beer. Inside the cab were two juvenile males out of their seats and no seat belts. The male driver had bloodshot and glossy eyes, and when talking with him his speech was slurred.


While the officer was speaking to the juveniles about the safety of wearing seat belts, he noticed open beer cans crushed on the passenger floorboard. The officer asked the driver, 35-year-old Gary Ryan Turner, if he could open the door and help the juvenile with a stuck seat belt, and Gary stated he could.


After helping the juvenile, Gary was asked to step out of the vehicle to talk about the multiple empty beer cans and drinking and driving with juveniles in the vehicle. When asked about drinking today, Gary stated he only had three beers.


Officer McGaha asked Gary to perform voluntary SFST's. He stated he would rather not but will anyway.


HGN- I observed 6 of 6 clues with vertical Nystagmus. I observed lack of smooth pursuit, Nystagmus at maximum deviation and Nystagmus prior to 45 degrees. I observed this in each eye. Turner is taller so he was seated on his vehicles rear bumper for HGN test. I still detected the odor of an alcoholic beverage emitting from his breath.


WAT—I observed 2 of 8 clues. I observed him step off line. I also observed his hands out from his body by approximately 6 inches.


OLS- I observed 2 of 4 clues. I observed him sway and place his foot down.


Gary performed a voluntary PBT and blew a .135. Gary was placed in custody and asked who could come and get the juveniles, and he called his family to come and get them.


While taking pictures of the vehicle, a juvenile held up a beer can just behind the center console. The beer was still cold to the touch.


Gary Turner was booked into the Uintah County Jail.
