| Ft. Duchesne, Ut. | August 15th, 2024 |

Three officers with the UHP, Uintah County Sheriff's Office, and the BIA all assisted with the intoxicated male at the Ute Petroleum gas station in Fort Duchesne. It was believed at the time that the male may have been involved in a possible domestic violence crime that occurred on US-40 in Gusher earlier in the day.

The details from the domestic call were as follows:

“A passerby observed a white male that was shirtless in blue jeans run across the highway and tackle a female wearing a red shirt and black sweatpants. A gray Volkswagen Beetle was parked nearby, and the complainant believed the vehicle to be involved. The passerby was not able to get a plate number from the vehicle. Uintah County Deputies, BIA, and I searched the area but couldn't locate the suspects."

UHP Trooper Searle arrived on scene at 9:38 pm and spoke with 37-year-old Earl Brent Jordan about the possible domestic violence incident. The trooper asked Earl if he got into a fight with his girlfriend, and he stated he did not.

It was learned that Earl didn't have a vehicle, and his girlfriend drove a silver pickup, not a Beetle.

Earl was shirtless and shoeless, and the trooper asked him where his clothes were. Jordan informed the trooper that his blue shirt was on a table across from them and that he had broken his foot, so he could not wear shoes. Trooper Searle asked Jordan where he lived, and he said he was homeless.

The trooper asked Earl how he got to the gas station. Earl stated he was being mean to his girlfriend, who dropped him off there. Earl said he did not tackle or hit his girlfriend.

Trooper Searle asked Earl where the argument took place, and he stated down the road, indicating to the south of them on 7500 E. Earl was asked what his girlfriend was wearing today, and he informed me he did not know. The trooper asked Jordan how he didn't know what his girlfriend was wearing when she dropped him off, and he started to get upset with Trooper Searle, stating he only looked at her face.

During their conversation, the trooper observed Earl had slurred speech, bloodshot eyes, and the odor of alcohol emitting from his person. The trooper asked if he had consumed any alcohol or drugs, and he informed Trooper Searle he hadn't. Earl was asked to stop lying to the trooper and asked what he was under the influence of. Earl informed the trooper he used marijuana a few days ago, but that was it.

Earl was getting upset and asked the trooper why he was asking him all these questions. Earl then stated that he had been drinking earlier. During their conversation, Earl kept getting more and more upset and leaned toward the trooper and said, "I'm getting pissed."

Due to Earl's demeanor, he was placed in handcuffs and put in the back of Trooper Searl's patrol vehicle.

Trooper Searle returned to his patrol vehicle to perform a records check on Earl and his girlfriend and found a phone number for the girlfriend. During this time, Jordan yelled at the trooper, stating if anyone messed with his girlfriend, he was going to kill them and their family. The trooper asked Earl who anyone was, and Earl said, “I didn’t say anything.”

Trooper Searle called the girlfriend and asked her what had happened earlier. She stated Earl was at her residence in Fort Duchesne when an argument started. Earl's girlfriend stated he had wished death upon her family. She stated she broke up with him and was taking him to his old girlfriend's house when he wanted out at the gas station, so she dropped him off there.

The trooper asked the girlfriend if she had been with him all day, and she informed me she was. He asked if they had gotten into an argument in the Gusher area, and she informed the trooper they had not. The trooper asked her if Earl had ever hit her or tackled her, and she stated he had not. Earl's girlfriend informed Trooper Searl they only had one argument before she dropped him off, and it was just verbal.

Trooper Searle asked her what vehicle she drove to, and she stated it was a silver truck. He asked Earl’s girlfriend if she had access to a silver Volkswagen Beetle, and she informed him that they did not. The trooper asked the girlfriend where she lived, and she told the trooper she lived in Fort Duchesne, south of the Ute Plaza.

Due to the circumstances, Trooper Searle didn’t believe that this was the couple involved in his domestic violence call from earlier in the day. The trooper then spoke with the Ute Petroleum employee, who contacted BIA about Earl being intoxicated. The employee informed me around 8:30 pm, Earl walked up to the store with a bottle of alcohol in his hand. The employee stated Earl sat in front of the store and started drinking until the bottle was empty.

The employee then stated she saw Jordan talking to himself and bothering customers. The employee informed Trooper Searle she watched Earl stumble into one of the customers. The employee told the trooper that Earl would open the door and hold it open for no reason until she asked him to close it.

The employee told the trooper Earl had also peed all over their bathroom floor. The employee showed Trooper Searl the alcohol container Earl had been drinking from inside the garbage next to the front door. The trooper asked the employee to fill out a witness statement, and she did so.

Trooper Searle returned to his patrol vehicle to speak with Earl. The trooper opened the cage door, and Earl yelled at the trooper, asking, "What the fuck was going on?"

Trooper Searle told Earl he could issue him a citation, release him to a responsible adult, or take him to jail. He then asked Earl if he had anywhere to go. Earl again said he was homeless and would walk the streets if he was released.

Earl was asked if he had any family members or friends who could take care of him. Jordan informed Trooper Searle that he could take him back to his girlfriends who lived close by and she would take care of him. Earl was informed Jordan that I was not going to do that due to his intoxication and their previous argument.

During this conversation, Jordan told Trooper Searle that his handcuffs were too tight. As he was loosening his handcuffs, Jordan informed the trooper he did not want to go to jail and that he was going to fuck him up.

Due to Jordan being intoxicated, his aggressive demeanor, and nowhere else to go but to be released back into the community to walk the streets, park, or church unattended, it was determined Earl may endanger himself or others and was placed under arrest at 10:28 pm.

As Earl was transported to the hospital for a medical clearance, he threatened to sue the trooper. As they got closer to Vernal, Earl threatened he and his friends would kill the trooper and his family. He made this threat multiple times. As they were coming into Vernal, Earl began yelling that he was going to cut Trooper Searl’s head off multiple times.

Because of Earl’s aggressive and threatening demeanor, Trooper Searle requested additional officers meet at the hospital. The trooper was informed that medical staff at the jail would evaluate him for the safety of the public and other officers; Earl was taken to the Uintah County Jail.

Earl was booked into the jail on charges of threat of violence against a peace officer, public intoxication, and unlawful consumption in a public place.
