A Duchesne County Deputy was dispatched to the area of the Mountain Home Church to a discharge of a firearm.

The reporting party stated that 37-year-old Zachery Wayne Oman fired two shots from a rifle toward him while he was on a neighbor's property.

Deputy Cox arrived at the property and spoke with the complainant, who stated that there had been prior issues with Zachery threatening to shoot or fire shots toward people when they got too close to his property.

The complainant advised that while he was on his friend's property, he was walking around and heard a shot from a gun go off. As he walked back to his truck, he heard another shot and saw the dust kick up about 100 to 150 yards from him.

Deputy Cox went to Zachery's residence and met the deputy outside.

Deputy Cox asked if he had fired any shots while out in the field. Zachery said he was near the oil well in the field, saw the individual on the property, knows who owns the property, and thought that the person may have been out hunting.

Zachery then stated he went to the top of the hill and fired off two shots from his rifle to scare the person. He said that he fired the shots off into the air. Deputy Cox advised him that the reporting party saw dust kick up near them after the shot went off.

Deputy Cox then advised Zachery that he was being placed under arrest and that it was illegal to shoot a weapon with the intent to scare or intimate someone unless his life was in danger.

Zachery then showed the deputy where the rifle he used in the incident was, which was seized. He was then transported and booked into the Duchesne County Jail for discharge of a firearm with intent to intimidate a person and shoot in their direction.

Zachery Wayne Oman is being held without bail.
