At 5:40 pm, Duchesne County Deputies responded to a residence in Duchesne on a domestic violence report. His mother had confronted the male subject for possibly smoking illegal drugs in his room.
A verbal altercation started where the male began yelling at his mother, and then, in the presence of two or more people, he pushed his mother backward with force. The subject then continued to yell obscenities at his mother.
Deputy Meeks spoke with this subject, identified as 22-year-old Damien Victor White.
Damien admitted to putting his hands on his mother in a way to move her backward to get her out of his way. Damien was placed under arrest for charges of domestic violence assault.
After the arrest was made and Damien was in custody he began yelling at his mother once more, he was directed to stop or he would be charged with disorderly conduct. He continued to yell in an even more violent matter.
Damien was placed into the back of a patrol vehicle, where he began to thrash around and scream profanities at his mother through a window that was partially down for him. He then kicked the confinement area not damaging anything.
Damien’s room was checked for illegal contraband and in a metal cup located on the TV stand right next to the door was a glass pipe that is found along with burnt tinfoil. At the bottom of the cup was a small yellow baggie normally associated with storing illicit narcotics was located. The bag contained a white crystal-like substance resembling that of Methamphetamine.
Sgt. Meeks ran a criminal history check on Damien, and it returned that he has prior convictions qualifying for an enhancement of charges on the following. That on 6/25/2024, this subject was found convicted of a Domestic Violence Charge of Protective order a Class A Misdemeanor and within 10 years of that date the subject has been arrested for another charge of Domestic Violence, and this charges is being submitted as a Felony 3.
Additionally, on 5/13/2024, Damien was convicted of disorderly conduct, filed as an infraction. And that since 5/13/2024, and not less than 5 years later, the subject was again arrested for the charge of disorderly conduct after having been given a lawful order to stop continued said behavior. As such, these charges will be submitted as a class B misdemeanor.
Based on the affirmation of Sgt. Meeks, the arresting officer, the undersigned magistrate finds that probable cause existed for the arrest without a warrant of Damien Victor White.
The current offense is a felony. The court finds substantial evidence to support the charge and finds by clear and convincing evidence that Damien Victor White would constitute a substantial danger to any other individual or to the community or is likely to flee the jurisdiction of the court if released on bail.
The current offense is a Domestic Violence offense. The court finds substantial evidence to support the charge, and finds by clear and convincing evidence that Damien Victor White would constitute a substantial danger to an alleged victim of domestic violence if released on bail.
Therefore, the court orders that Damien Victor White is to be held without bail.
