A man gets a DUI in the Burger King drive-thru

Roosevelt City Police were called to an accident at the Burger King at 525 South State Street, where a white Nissan truck struck the building and was still in line at the drive-thru.
Officer Bellon arrived on scene and saw the truck matching the description, and made contact with the driver, 34-year-old Kenneth Larry Mortensen.
The officer told Kenneth it was reported that he hit the building, but he said he didn't remember hitting it. Officer Bellon had Kenneth move his truck out of the drive-thru line and park it out of the way.
After Kenneth parked his truck, he got out and stood next to his vehicle, swaying. The officer asked if he had been drinking, and Kenneth replied no.
Officer Bellon noticed scratches on the side of his truck, which Kenneth said were from some fenders he had removed.
The officer had Kenneth get back in the seat of his truck and spoke with one of the employees who saw the accident. The employee stated he saw Kenneth hit the side of the building and noticed that Kenneth had a drink or something in his hand. The employee stated it looked similar to a beer can.
Kenneth was asked if he would do Field Sobriety Tests, to which he agreed.
Based on the results of the field sobriety tests, Kenneth was placed under arrest for DUI and transported to the Duchesne County Jail.
Based on the affirmation of Officer Bellon, the arresting officer, the undersigned magistrate finds that probable cause existed for the arrest without a warrant of Kenneth Larry Mortensen. Kenneth Larry Mortensen may post bail in the amount of $1,000.00.
If Kenneth Larry Mortensen posts bail as stated above, Kenneth Larry Mortensen is hereby ordered to be released subject to the following conditions:
•Promise to appear for all required court proceedings
•Promise to not commit any criminal offense
•Report your contact information and any change in address, phone or email to the Court and your attorney within 1 business day of the change
•1 phone contact per month (1st Monday of each month)
•Fee: $20 (per month)
•Warrant amount for failing to call in: $100 (per month)
•Appear in court when required
•Commit no new offenses during the period of release
