A male with cuts around his face walks into the Vernal Police Department to report his brother had hit him

Dispatch called a Vernal City Officer to a reported domestic assault where the victim was at the Vernal City Police Department. The victim had multiple small cuts around his face, knees, and arms.


The victim told Officer Maughan that 49-year-old David Tell Sharp, who is his brother, hit him and pushed him onto the ground. The victim said the cuts on his body were from David pushing his head and body into the gravel at their residence.


Officer Maughan attempted to speak with David at their home, but he refused several lawful commands to come out of the house. David was hiding in the hallway, which law enforcement couldn't see.


Multiple law enforcement Officers arrived and ordered David out of the residence to speak with them, but again, he refused. While David was refusing police lawful commands, he did admit that he and the victim had gotten into an argument.


The front door to David's residence was open, and when David went to close it two officers attempted to grab David, but he pulled away where the assisting officers and Officer Maughan had to place David on the ground and was ordered several times to place his hands behind his back.


David mocked the officers by repeating them, saying, "Place your hands behind your back."


While attempting to place David into handcuffs, the smell of an alcoholic beverage was emitting from his breath.


While David was being transported to the Uintah County Jail he stated in an elevated voice, “Me and my brother get into a little fight here, and I go back to jail, really? I can't fuck my brother up!"


Based on the affirmation of Officer Maughan,  the arresting officer, the undersigned magistrate finds that probable cause existed for the arrest without a warrant of David Tell Sharp. David Tell Sharp may post bail in the amount of $2,000.00.
