Sgt. Johnstun was contacted by a female at the Vernal Police Department who arrived at the parking lot on foot. The female stated that 53-year-old Christopher Michael Roseberry hits and is mean to her.

The female indicated that the issues with Christopher have been going on for years, but she was fed up with it. She said Christopher had been drinking this morning, and they were arguing.

The female said this morning, she was doing her hair when Christopher grabbed her by the throat and held her down on the bed. She stated she couldn't breathe when Christopher had her by the throat. The female told the officer there was a hair dye stain on the bed where her head was pressed down on the bed.

The woman said Christopher was drunk and that he was always drinking.

Sgt. Johnstun noticed marks on the female's neck consistent with strangulation. She also indicated that Christopher had broken a table because he was angry. The female said Christopher hit her in the head with a piece of the broken table leg during the argument.

After the incident, the female got into the shower. Christopher got in the shower with her and demanded she shower him. Christopher was pushing her against the bath faucet and wall and slapped her on the back.

The female stated she was scared of Christopher and called for her daughter. Her daughter heard her, came to the bathroom, and yelled at Christopher to get out.

Sgt. Johnston went to the female's residence and saw Christopher outside. The female's daughter was visibly distraught and had been crying, so she ran away from Christopher and into the residence.

Christopher began walking toward the residence and ignored the officer's commands to stop. Sgt. Johnstun grabbed Christopher while on the front porch and advised him he was detained. The officer immediately noted a strong odor of an alcoholic beverage emitting from Christopher's breath as he spoke. Christopher admitted he had been drinking alcohol.

The officer asked Christopher to tell him what was going on this morning. Christopher indicated he and the female were arguing but denied hitting or pushing her and stated they were having sex in the shower. Christopher also denied grabbing the female by the throat.

Christopher indicated he had intentionally broken the table because the female wanted the table taken apart.

Sgt. Johnstun then spoke to the female's daughter. She stated she was asleep and was woken by a loud noise. She went to see what it was, saw the broken table, and returned to her bedroom.

The daughter said she was awoken by her mother screaming and calling her name from the bathroom. She went to the bathroom, where her mother was calling for help, and she yelled at Christopher to get out, and he yelled something back. The daughter stated her mother left the residence but didn't know where she went.

Christopher was arrested for aggravated assault, property damage, intoxication, and domestic violence in the presence of a child.

Christopher was then booked into jail for the above offenses.

Christopher was removed from the residence and Sgt. Johnstun spoke with the two females inside the home. The officer noted that the table was broken on the floor, one of the table legs was on the counter, and there was a stain on the bed sheet, consistent with the description given by

the victim.

Based on the affirmation of Sgt. Johnston, the arresting officer, the undersigned magistrate, finds that probable cause existed for the arrest of Christopher Michael Roseberry without a warrant.

The current offense is a Domestic Violence offense. The court finds substantial evidence to support the charge and finds by clear and convincing evidence that Christopher Michael Roseberry would constitute a substantial danger to an alleged victim of domestic violence if released on bail.

Therefore, the court orders that Christopher Michael Roseberry is to be held without bail.

Whowever this woman is, deserves a medal for standing up for herself, and finally saying enough is enough. We are proud of you!!
