A female is life-flighted to a Provo hospital, and a Fruitland man is arrested for selling prescription drugs

On March 29, 2025, Deputies with the Duchesne County Sheriff's Office responded to a residence in Fruitland, Utah, for a medical episode involving a female victim.


When first responders arrived, the female was found unresponsive, and CPR was immediately started. A short time later, EMS arrived and transported the female to Heber Valley Hospital, where she was later life flighted to the Utah Valley Regional Medical Center in life threatening conditions.


During the investigation of the scene, deputies located a prescription bottle next to where the female was laying that contained Percocet pills prescribed to 60-year-old Cole C Warner.


There was also a baggie that contained crushed-up Percocet pills located inside the bottle.


A urinalysis test was administered at the Heber Valley Hospital that showed that the female was positive for opiates.


During the female’s stay at the Utah Valley Regional Medical Center, she was placed on a ventilator and was not expected to survive.


A few days after the incident, Detective Hunter received a call from a family member of the female informing the detective he had found some text messages on the female's phone from Cole Warner referencing supplying her with "vitamins" and referencing several different meeting places to pick up the "vitamins."


It was clear to the detective that Cole was referring to illegal drugs that he was providing to the female that she possibly overdosed on.


After several weeks, the female made a miraculous recovery and was released from the hospital and placed in a rehabilitation center to continue treatment.


On April 29, 2025, Detective Hunter went to the rehabilitation center to interview the female about the “vitamins” discussed in the text messages.


The detective then asked her what Cole was referring to when he referenced the Vitamins he was providing her with. The female stated that the vitamins were actually Percocet pills. She explained that Cole had been providing them to her since the end of October 2024, when her mother passed away, and she started having health issues involving severe pain.


The female stated Cole would provide the pills to her in a prescription pill bottle with no label and that she would meet Cole to purchase the pills approximately once a week. The female said she would usually purchase anywhere between 30-50 pills at a time, and most of the purchases were for 50 pills, and Cole charged them $400 for the 50 pills.


She added on one occasion Cole charged them $500 for the 50 pills.


It is suspected that over a 5-month period from November 2024 to March 2025, Cole sold the female approximately 980 Percocet pills at a total cost of around $8100.00 dollars. The female also disclosed that Cole sold them an undetermined amount of raw marijuana on one occasion during that 5-month period.


Cole Warner is being charged with the two counts of drug distribution listed in this Probable Cause Affidavit.


Cole was also arrested and charged with Vehicle theft in Summit County for taking and keeping the female's truck without permission the day following her medical episode. At the time of his arrest, he was on felony probation with AP&P.


Detective Hunter wrote in the Probable Cause Affidavit, “The offender is a lifelong criminal with charges ranging from theft to drug possessions and several DUI convictions. He was on felony probation with AP&P at the time of his arrest, and based on the charges listed in this probable cause affidavit, he is a danger to continue selling illegal drugs in the community if released. The offender also has several acquaintances outside the Uintah Basin area and should be considered a severe risk to flee prosecution should he be released on bail."


The current offense is a felony. The court finds substantial evidence to support the charge and clear and convincing evidence that Cole C Warner would constitute a substantial danger to any other individual or the community or is likely to flee the jurisdiction of the court if released on bail.


Therefore, the court orders that Cole C Warner be held without bail.
