At around 6:44 p.m., UHP Trooper Smith was asked to assist with a possible DUI near milepost 37 on SR-87. When the trooper arrived on scene, Officer Miller with the DWR was out of his vehicle talking to a male leaning on a tan Suburban.

Trooper Smith briefly spoke with Officer Miller, and he described the driving pattern before pulling the vehicle over.

Officer Miller stated he saw the vehicle swerve into the oncoming lane of travel at speeds upwards of 90 mph in a 55 mph zone. The vehicle went over the fog line, off the road, kicking up dirt and dust, then moving back onto the roadway.

Trooper Smith approached the driver, identified as 45-year-old Andrew John Ames, to talk to him about performing the standard field sobriety tests (SFSTs) to determine whether he was safe to drive.

When the trooper approached Andrew, he noticed his pants were wet with urine and was having a hard time standing upright even while leaning against the Suburban. The trooper told Andrew he wanted him to perform the SFSTs, to which he consented.

Trooper Smith began by asking Andrew if he had any medical concerns or injuries that would prevent him from doing any of the tests, He stated that he had a hip replacement, and it hurt to stand or walk.

The trooper did not have Andrew perform the walk-and-turn test because he was concerned about his hip and did not want to risk injury.

After going through the SFSTs, Trooper Smith felt like Andrew was too impaired to operate a motor vehicle. Andrew blew into the PBT, which read .151, showing the presence of alcohol.

Andrew Ames was arrested for DUI and taken to the Uintah Basin Medical Center in Roosevelt, where he consented to a blood draw. Andrew was then transported to the Duchesne County Jail and charged with DUI and alcohol-restricted driver.
