A Duchesne County woman charged with threat of violence and damaging a police vehicle

The Duchesne County Sheriff's Office was dispatched to a report of a female subject driving on SR-87 from milepost 10.5 in Talmage.


The complainant stated he and his girlfriend had been arguing when she threatened to kill herself and left the residence. He said that they have been having problems because he caught her driving while high with their children recently and other drama.


Cpl. Cox located the vehicle and attempted to speak with 29-year-old Harley Colette Foster, who is deaf. The deputy used his phone to communicate, but Harley wasn't cooperative.


A couple of hours later, the complainant made contact with Cpl. Cox again stating that Harley had returned home and punched a wall. While the deputy was on the phone, he could hear Harley yelling in the background.


The complainant informed the deputy that he needed help from law enforcement and Cpl. Cox quickly arrived on the scene on West Mortensen Lane and met with the complainant outside. Harley was also at the door of their trailer arguing with him while he spoke with Cpl Cox.


The complainant told the deputy that Harley had returned to the house and called him names for not pressing charges against her earlier. He was attempting to make dinner for them all and had also made an effort to make their living arrangement work for the family, but Harley would not leave him alone.


The complainant stated that during the argument, Harley punched a wall and hit a light cover that fell off; however, she put it back on the wall.


He then continued to tell the deputy that Harley had told him to call the cops because she no longer cared. The boyfriend said Harley then went at him aggressively, clenched her fist, and brought her arm up. He said that he moved back because he believed that she was going to hit him.


Cpl Cox went to speak with Harley. She began to write her side of the story on a notepad about the argument, stating that her boyfriend didn't want anything to do with her and claimed he was being spiteful.


She continued to write, but it started to become illegible, so the deputy began to use his phone to communicate.


Cpl Cox asked Harley, "At any point, were you mad and clenching your fists or moving in his direction with your fists clenched?" Harley replied, "I stood up fast because he wouldn’t stop screaming at me, and I told him that I dare you to call the cops because I don't care anymore.”


Harley was then placed under arrest for domestic violence-threat of violence and placed in the back of the patrol truck.


Harley began to yell out of the window while her boyfriend was writing his witness statement. She began to hit the back window of the patrol truck very hard and was warned to stop, but she refused and continued.


Cpl Cox conducted a check of the area where Harley was sitting to see if anything was broken. He saw that the door paneling was broken and had popped out towards the top and would not go back into its place. On the door were scuff marks from where Harley was kicking the panel.


The deputy told Harley that she was being charged with damage to jails, and she claimed that she hadn't broken it. He then showed Harley the damage, which she claimed wasn't her, and pointed to another scuff mark near the bottom of the cage that she claimed was from her.
